The Obama administration is well known for doing whatever the hell it wants. It ignores congress, regulation, long standing traditions, the law, the constitution, and common sense. But, is it time to add the Supreme Court to that list?
Yes, says the New York Times. In a piece subtly titled "Could Obama Bypass the Supreme Court?," William Baude argues that if the latest legal threat to Obamacare doesn't go their way-- they could just pretty much ignore it.
Some quick background: the case is King vs Burwell which, if the world made sense, would remove the free cash to those on Obamacare in states that did not create their own exchange. Why? Because that's how the law is written. Ask Jonathan Gruber.
So, how does Obama get around the ruling from the Supreme Court if he doesn't like it?
"If the administration loses in King, it can announce that it is complying with the Supreme Court’s judgment — but only with respect to the four plaintiffs who brought the suit."
Get it? Picture if Roe vs Wade didn't allow women the right to an abortion, it just specifically allowed one person, Roe, to get an abortion.
Or, if Brown vs the Board of Education didn't force segregation for all schools for all races, it just allowed Linda Brown the chance to go Sumner Elementary School.
Could Obama really be so in love with his own power that he would actually attempt to do this?
