Arguing with Idiots Video Contest
OFFICIAL RULES
NO PURCHASE NECESSARY. A PURCHASE WILL NOT INCREASE YOUR
CHANCES OF WINNING.
1.
PROMOTION PERIOD:
Arguing with Idiots Video Contest (the “Contest”) begins at
12:00:01am
Eastern Time (“ET”) on October 7, 2009 and ends at 11:59:59pm
ET on November 13, 2009 (the “Promotion Period”). During
the Promotion Period, there will be three (3) segments as set
forth below. YouTube, LLC’s computer is the official time
keeping device for this Contest.

2.
ELIGIBILITY:
The Contest is open to legal residents of the forty-eight
(48) contiguous United States or District of Columbia who
are at least eighteen (18) years of age or older as of the
date of entry. Subject to all applicable federal,
state, and local laws and regulations. Void where prohibited
or restricted by law. Individuals who have won a prize
from the Sponsor or Radio Show within one hundred eighty
(180) days prior to the start date of this Contest are not
eligible.
Employees of
Mercury Radio
Arts, Inc. (the “Sponsor”), Premiere Radio Networks, Inc. (the
“Administrator”),
and The Glenn Beck Program (the
“Radio Show”) (collectively, the “Contest Entities”), each radio
station contracted to broadcast the Radio Show, and their respective
subsidiaries and affiliated companies,
divisions, parent companies,
officers, directors, agents and advertising agencies, as well
as members of the immediate family of any such employees, are
not eligible to participate and win. The term “immediate
family” includes spouses, siblings, parents, children, grandparents,
and grandchildren, whether as “in-laws,” or by current or past
marriage(s), remarriage(s), adoption, co-habitation or other
family extension, and any other persons residing at the same
household whether or not related.
3.
HOW TO ENTER:
During the Submission Period, complete the following steps to
submit your entry video: (1) Visit http://www.youtube.com
and log on or create a free account. Upload an original
video created by you based on the theme, “Arguing with Idiots”
(the “Theme”) then, (2) Visit http://www.glennbeck.com
and follow the Contest link to complete all required information
in the online entry form including a link to the video posted
on YouTube. All entries will become property of the Sponsor
and will not be returned.
Participants who enter the Contest with a video which contains
other actors/participants must obtain a consent and release
from each actor/participant. Only one participant entry
per video and any prize awarded in the Contest will only be
made to the Contest participant. Participant must to be
the owner of the material submitted. No licensed materials
accepted.
Valid Contest entries must contain all information
requested. Incomplete entries will be disqualified.
All entries must be received during the Submission Period to
be eligible for consideration. All participants and video
actors/participants must be at least eighteen (18) years
old. All entries become the property of the Sponsor and will
not be returned. Videos can only be entered once into the
Contest and by one (1) individual. One (1) prize per
household.
4.
ENTRY GUIDELINES:
All video entries submitted must be no larger than 320 x 240
pixels of a video promoting the Theme.

Must be in a format acceptable by YouTube (acceptable formats
can be found here:
http://www.google.com/support/youtube/bin/answer.py?hl=en&answer=55744).
·
Promotes the Theme in a positive manner.
·
Must not exceed two (2) minutes in length.
·
Includes at least one (1) mention of the phrase “Arguing with
Idiots”.
·
Must be FCC acceptable, including no use of indecent or obscene
material or language.
·
Must comply with YouTube’s Terms of Service:
http://www.youtube.com/t/terms.
·
Content should not infringe or violate any copyright, patent,
trademark, trade secret, right of publicity, or other intellectual
property, proprietary, or contractual right of a third party.
·
No defamatory or libelous material or material which discloses
private or personal matters concerning any person, without such
person’s consent.
·
No content or material that is illegal, contains nudity or is
sexually explicit, or by law, obscene, profane or pornographic.
·
No content which implies or portrays crime or graphic violence.
·
No content which is abusive or harassing towards any individual
or group of individuals regarding race, sex, religion, creed,
national origin, age, disability, gender identity or expression,
sexual orientation or any legally protected classification.
Specifically this includes, but is not limited to, epithets
or slurs (such as the “N” word), threats, intimidations, or
hostile acts.
The Sponsor reserves the right to reject any entry, in their
sole discretion, based on current broadcast standards and other
programming and operating practices and policies established
by the Sponsor for airing advertising.
BY ENTERING THE CONTEST, YOU ARE VERIFYING THAT YOU ARE THE
OWNER AND PRODUCER OF THE SUBMITTED MATERIAL AND THAT NO THIRD
PARTY OWNSHIP RIGHTS EXIST TO THE VIDEO SUBMITTED. BY
ENTERING THE CONTEST, YOU ARE TRANSFERRING ALL OWNERSHIP RIGHTS
OF YOUR SUBMITTED VIDEO TO THE SPONSOR, AS DEFINED ABOVE.
YOUR SUBMITTED VIDEO RECORDING WILL NOT BE RETURNED AND YOU
WILL NOT BE PERMITTED TO USE THE SUBMISSION FOR ANY VIDEO USE
AFTER IT HAS BEEN SUBMITTED.
5.
JUDGING/VIEWING
DETAILS:
Judging Period:
During the Judging Period, a panel of judges provided by the
Sponsor will select ten (10) finalists (the “Finalist(s)”) from
all eligible video entries received based on the following criteria
(the “Judging Criteria”):

Originality;
·
Creativity;
· Humor;
·
Use of the Theme.
Each of the four (4) Judging Criteria items can earn a maximum of twenty-five
(25) points for a total maximum of one hundred (100) points.
All decisions of the judges are final. Sponsor reserves
the right to select less than ten (10) Finalists, if, in its
sole discretion, it does not receive a sufficient number of
eligible video entries.
Public Viewing Period:
During the Public Viewing Period, each Finalist’s video
entry will be posted at
the Radio Show’s website for people to view.
If an entry receives multiple
and/or irregular views or multiple views from the same user
or users, including but not limited to, views generated by a
robotic, programmed, script, macro, other automated means or
other source, the Sponsor reserves the right to disqualify the
Finalist in its sole discretion.
By participating in the viewing portion of this Contest, each
viewing participant agrees to be bound by these official Contest
rules.
6.
WINNER SELECTION: The Finalist video entry that
receives the most views, based on YouTube’s viewer counter,
during the Public Viewing Period will be deemed the Grand
Prize winner. In the event of a tie during either the
Judging Period or Public Viewing Period, an additional,
qualified, "tie-breaking" judge shall determine the Grand
Prize winner from such tied entries using the Judging
Criteria herein. All decisions of the judges will be
final. Winners agree to be bound by these Official
Rules and the decisions of the Sponsor, whose decisions are
final on all matters relating to this Contest
7.
PRIZES:
ONE (1) GRAND PRIZE;
A trip for two
(2) people to New York, NY plus a Runner-Up prize pack.
The trip includes round trip coach airfare for two (2) people
from the major airport nearest the winner’s home to the major
airport nearest New York, NY (as determined by Sponsor), two
(2) nights hotel accommodations (double occupancy), one (1)
dinner for two (2) at a local restaurant, a one (1) hour visit
for two (2) to watch the Radio Show live, and airport transfers
(Approximate Retail Value (“ARV”): $3,389.88).
NINE (9) RUNNER-UP
PRIZES; One (1) autographed copy of each of the books “Arguing
with Idiots” (ARV: $ 29.99) and “The Christmas Sweater” (ARV:
$19.99), a twelve (12) month subscription to GlennBeck.com’s
Insider (ARV: $54.95), and ten (10) issues of “Fusion” magazine
(ARV: $34.95). The
total ARV of all prizes is $4,648.80. Grand Prize
travel must take place by December 3, 2010 and is subject to
the Radio Show’s schedule and availability. Grand Prize
winner and guest will be subject to a background check prior
to travel and may be offered an alternative cash prize, at the
Sponsor’s sole discretion. A minor must be accompanied
by a parent or legal guardian. Grand Prize winner and
guest must travel out of the same airport and on the same itinerary.
Certain travel restrictions and blackout dates may apply.
Meals, incidentals, gratuities, phone calls, luggage fees, and
any and all other expenses not specifically mentioned herein
are the sole responsibility of the Grand Prize winner and each
Runner-Up winner. Sponsor, in its sole discretion, reserve
the right to provide ground transportation in lieu of air transportation
if Grand Prize winner resides less than one hundred (100) miles
from the prize destination. The Sponsor reserves the right
to substitute any portion of these prizes, including destination
and travel dates, for a prize of equal or greater value.
No transfer, assignment,
change of the prize, or cash substitution is permitted
except at the sole discretion of the Sponsor. If a winner
cannot be contacted or is disqualified, the Sponsor reserves
the right to determine an alternate winner in its sole discretion.
Unclaimed prize(s) will not be awarded. Other restrictions
may apply. All federal, state, and local taxes on the
prize are the sole responsibility of each winner.
8.
TELEPHONE AND DELIVERY DISCLAIMER: The Sponsor disclaims all liability for the inability of a participant
to complete or continue a telephone call or online entry due
to equipment malfunction, busy lines, inadvertent disconnections,
acts beyond the Sponsor’s
control, or otherwise.
The Sponsor disclaims all liability for any delays, misdelivery,
loss, or failure in the delivery of any item sent by electronic
transmission or other delivery method. The Sponsor is
not responsible for human, mechanical, technical, electronic,
communications, telephone, computer, hardware or software errors,
malfunctions or failures of any kind, including: any form of
active or passive filtering, insufficient space in participant’s
e-mail account to receive e-mail messages, failed, incomplete,
garbled or delayed transmission of online entries, traffic congestion
on telephone lines, the Internet, or on any website, or lost
or unavailable network connections which may limit an online
participant's ability to participate in the Contest, and any
injury or damage to participant’s or any other person’s computer
related to or resulting from participating in or downloading
any information necessary to participate in the Contest.
No mechanical reproductions will be accepted. The use
of automated software or computer programs to register or enter
the Contest is prohibited, and any individual who uses or attempts
to use such methods to register or to enter will be disqualified.
Entries void if incomplete, defective, altered, forged, illegible,
or received outside authorized channels. All entries and
information become property of the Sponsor and will not be returned.
9.
VIEWING CONTESTS:
By participating in the viewing portion of any contest, each
viewing participant agrees to be bound by the official contest
rules. If a participant receives multiple and/or irregular
votes or multiple votes from the same user or users, including
but not limited to, votes generated by a robotic, programmed,
script, macro, other automated means or other source,
the Sponsor reserves the right to disqualify the participant
in its sole discretion. If the contest includes the use
of an internet tool and the internet viewing process fails to
operate properly or appears to be tampered with or tainted with
errors, fraud or unfair practices, the Sponsor reserves the
right to use another means to determine the winner(s), i.e.
random selection or appointing a panel of judges. All
decisions of the judges are final.
10.
PUBLICITY; USE
OF PERSONAL INFORMATION:
By participating, where allowed by law, all participants and
winner(s) grant the Contest Entities exclusive permission to
use their names, characters, photographs, voices, videotape,
biographical information, and/or likenesses in connection with
promotion of this and other contests and waive any claims to
royalty, right, or remuneration for such use. By participating
in the Contest, where allowed by law, participants agree that
the Contest Entities may disclose personal information obtained
from participants in the Contest to third parties and use such
information for marketing and other purposes.
11.
CONSUMER CREATED
CONTENT: If the entry for the Contest requires creative material from the participant,
by submitting your entry: (1) you agree that your disclosure
is gratuitous, unsolicited and without restriction and will
not place the Sponsor or Contest Entities under any fiduciary
or other obligation, that the Sponsor is free to disclose the
ideas on a non-confidential basis to anyone or otherwise use
the ideas without any additional compensation to you;
(2) you acknowledge that, by acceptance of your submission,
the Sponsor and Contest Entities do not waive any rights to
use similar or related ideas previously known to Sponsor, or
developed by their employees, or obtained from sources other
than you; (3) you are verifying that you are the owner and producer
of the submitted material and that no third party ownership
rights exist to any material submitted, and (4) you are hereby
granting the Sponsor and Contest Entities a perpetual, worldwide,
non-exclusive, royalty-free, sub-licensable (through multiple
tiers) right and license to use, publish, reproduce, display,
perform, adapt, modify, distribute, have distributed and promote
such content in any form, in all media now known or hereinafter
created, anywhere in the world, for any purpose.
12.
TAXES:
Any valuation of the prize stated above is based on available
information provided to the Contest Entities, and the value
of any prize awarded to a winner will be reported for tax purposes
as required by law. Each winner is solely responsible
for reporting and paying any and all applicable taxes related
to the prize and paying any expenses associated with any prize(s)
which are not specifically provided for in the Official Rules.
Winners must provide the Contest Entities with valid identification
and a valid taxpayer identification number or social security
number before any prize will be awarded. Any person winning
over $600.00 in prizes from the Contest Entities will receive
an IRS form 1099 at the end of the calendar year and a copy
of such form will be filed with the IRS.
13.
CONDUCT AND
DECISIONS: By
participating in the Contest, participants agree to be bound
by the decisions of Sponsor personnel. Persons who violate
any rule, gain unfair advantage in participating in the Contest,
or obtain winner status using fraudulent means will be disqualified.
Unsportsmanlike, disruptive, annoying, harassing or threatening
behavior is prohibited. The Sponsor will interpret these
rules and resolve any disputes, conflicting claims or ambiguities
concerning the rules or the Contest and the Sponsor’s decisions
concerning such disputes shall be final. If the conduct
or outcome of the Contest is affected by human error, any mechanical
malfunctions or failures of any kind, intentional interference
or any event beyond the control of the Sponsor, the Sponsor
reserves the right to terminate this Contest, or make such other
decisions regarding the outcome as the Sponsor deems appropriate.
All decisions will be made by the Sponsor and are final.
The Sponsor may waive any of these rules in its sole discretion.
Any attempt by a participant or any other individual to deliberately
circumvent, disrupt, damage or undermine the legitimate operation
of this Contest is a violation of criminal and civil laws. Should
such an attempt be made, the Sponsor reserves the right to seek
civil and/or criminal prosecution and/or damages from any such
person to the fullest extent permitted by law.
14.
RELEASE:
Participants release the Contest
Entities, each radio station contracted to broadcast the Radio
Show, and their respective subsidiaries and affiliated companies,
divisions, parent companies,
officers, directors, employees, agents and advertising agencies
and all others associated with the development and execution
of the Contest, from and against any and all liability with
respect to or in any way arising from this Contest and the awarding
and use of the prize, including without limitation liability
for death, personal injury, loss, and/or disability.
15.
MISCELLANEOUS:
Winner(s) must submit proof of eligibility and may be required
to sign the Administrator’s Affidavit to claim the prize.
The Sponsor may substitute prizes, as well as extend, modify,
or discontinue the Contest at any time without prior notice.
The Sponsor disclaims any responsibility to notify participants
of any aspect related to the conduct of the Contest.
The Contest Entities are not
responsible for any typographical error in the printing of these
Official Rules, administration of the Contest or in the announcement
of the Contest prizes.
16.
WINNER LIST:
To view the Grand Prize and Runner-Up winners’ video entries,
visit the Radio Show’s website by November 24, 2009.
17.
JURISDICTION:
These Official Rules shall be governed by and construed in accordance
with the laws of the State of New York. Venue and jurisdiction
for any claims associated in any way with these rules shall
only be proper in the State of New York.
