So it's no surprise people's eyes glaze over at the mention of "civil asset forfeiture." Call it something else --- legalized governmental theft --- and they just might perk up.</p><p>Don't think it exists? Just ask Lyndon McClellan, whose bank account of more than $107,000 was <a href="http://ij.org/case/north-carolina-forfeiture/" target="_blank">seized by the IRS</a> in 2014. As the owner of a convenience store in Fairmont, North Carolina for over a decade, the IRS deemed McClellan's frequent cash deposits evidence of criminal activity, and a good enough reason to take his money --- even though he was never charged with a crime.</p><p><span class="rm-shortcode" data-rm-shortcode-id="P3RY3M1576286391" style="display:block;position:relative;padding-top:56.25%;"><iframe frameborder="0" height="auto" lazy-loadable="true" scrolling="no" src="https://www.youtube.com/embed/uGtFWC-12-w?rel=0" style="position:absolute;top:0;left:0;width:100%;height:100%;" width="100%"></iframe></span> </p><p>If it could happen to McClellan, it could happen to anyone.</p><p>Here are some facts you should know about how the government lawfully takes property from innocent citizens.</p><p></p><h2>What Is It?</h2> <p>According to the Institute for Justice, civil asset forfeiture is the process by which the government <a href="http://endforfeiture.com/" target="_blank">takes and sells someone's property</a> without ever convicting them with a crime, and "one of the greatest threats to property rights in the nation today."</p><p>They go on to describe how these cases proceed under the "legal fiction" that cash, cars or homes can be "guilty," leading to some bizarre case names such as, "United States v. 434 Main Street, Tewksbury, Mass." Because these cases are technically civil actions, property owners are not considered eligible to receive standard protections merited to criminal defendants, such as an attorney and a trial.</p><p></p><h2>How Did It Start?</h2> <p>The roots of civil asset forfeiture laws date back to the 1600s in England, eventually making their way into colonial law, which earns them one of the longest running legal legacies on record. Popularized during the prohibition era and used sparingly in the 20's and 30's, these laws temporarily fell out of favor until the drug wars of the 1980s.</p><p></p><h2>What's the Argument for Keeping It?</h2> <p>Some people --- particularly in law enforcement --- love the program and will fight tooth and nail to not only keep it but expand its use even further. Those in favor see it as a way to stop drug cartels and limit the ability of drug dealers and "bad hombres" to engage in illicit business.</p><p>The Federalist Society makes <a href="http://www.fed-soc.org/publications/detail/forfeiture-is-reasonable-and-it-works" target="_blank">these points</a> in favor of the law:</p><p></p><blockquote>The government also uses forfeiture to take the profit out of crime, and to return property to victims. No one has the right to retain the money gained from bribery, extortion, illegal gambling, or drug dealing. With the forfeiture laws, we can separate the criminal from his profits --- and any property traceable to it --- thus removing the incentive others may have to commit similar crimes tomorrow. So it's no surprise people's eyes glaze over at the mention of "civil asset forfeiture." Call it something else --- legalized governmental theft --- and they just might perk up.</p><p>Don't think it exists? Just ask Lyndon McClellan, whose bank account of more than $107,000 was <a href="http://ij.org/case/north-carolina-forfeiture/" target="_blank">seized by the IRS</a> in 2014. As the owner of a convenience store in Fairmont, North Carolina for over a decade, the IRS deemed McClellan's frequent cash deposits evidence of criminal activity, and a good enough reason to take his money --- even though he was never charged with a crime.</p><p><span class="rm-shortcode" data-rm-shortcode-id="P3RY3M1576286391" style="display:block;position:relative;padding-top:56.25%;"><iframe frameborder="0" height="auto" lazy-loadable="true" scrolling="no" src="https://www.youtube.com/embed/uGtFWC-12-w?rel=0" style="position:absolute;top:0;left:0;width:100%;height:100%;" width="100%"></iframe></span> </p><p>If it could happen to McClellan, it could happen to anyone.</p><p>Here are some facts you should know about how the government lawfully takes property from innocent citizens.</p><p></p><h2>What Is It?</h2> <p>According to the Institute for Justice, civil asset forfeiture is the process by which the government <a href="http://endforfeiture.com/" target="_blank">takes and sells someone's property</a> without ever convicting them with a crime, and "one of the greatest threats to property rights in the nation today."</p><p>They go on to describe how these cases proceed under the "legal fiction" that cash, cars or homes can be "guilty," leading to some bizarre case names such as, "United States v. 434 Main Street, Tewksbury, Mass." Because these cases are technically civil actions, property owners are not considered eligible to receive standard protections merited to criminal defendants, such as an attorney and a trial.</p><p></p><h2>How Did It Start?</h2> <p>The roots of civil asset forfeiture laws date back to the 1600s in England, eventually making their way into colonial law, which earns them one of the longest running legal legacies on record. Popularized during the prohibition era and used sparingly in the 20's and 30's, these laws temporarily fell out of favor until the drug wars of the 1980s.</p><p></p><h2>What's the Argument for Keeping It?</h2> <p>Some people --- particularly in law enforcement --- love the program and will fight tooth and nail to not only keep it but expand its use even further. Those in favor see it as a way to stop drug cartels and limit the ability of drug dealers and "bad hombres" to engage in illicit business.</p><p>The Federalist Society makes <a href="http://www.fed-soc.org/publications/detail/forfeiture-is-reasonable-and-it-works" target="_blank">these points</a> in favor of the law:</p><p></p><blockquote>The government also uses forfeiture to take the profit out of crime, and to return property to victims. No one has the right to retain the money gained from bribery, extortion, illegal gambling, or drug dealing. With the forfeiture laws, we can separate the criminal from his profits --- and any property traceable to it --- thus removing the incentive others may have to commit similar crimes tomorrow. Their statistics show a jump from 469 incidents in 2015 to 613 in 2016 and 30 already reported this year.</p><p>The <a href="http://www.adl.org/press-center/press-releases/anti-semitism-usa/2015-audit-anti-semitic-incidents.html#.WJi6RxIrI6g?referrer=https://www.bustle.com/p/why-erasing-anti-semitic-graffiti-on-the-subway-is-not-resisting-trump-35922" target="_blank">Anti-Defamation League released a report</a> showing a 50 percent increase in violent anti-Semitic assaults since 2014. This past month, a <a href="http://www.theblaze.com/news/2017/02/01/dozens-of-bomb-threats-made-at-jewish-centers-across-us-in-recent-weeks-feds-investigating/" target="_blank">rash of bomb threats</a> plagued Jewish centers around the country --- 57 threats in 26 states to be exact.</p><p>Some have been quick to <a href="http://www.huffingtonpost.com/entry/responding-to-anti-semitism-in-the-age-of-the-alt_us_5898c7e4e4b0985224db57df" target="_blank">point the finger at Donald Trump</a> for this uptick in violent rhetoric and threats. There is absolutely zero evidence that it did --- but there's also zero evidence that it came from a far-right Trump supporter.<p>The fact that we simply do not know the motivation behind the person or people who defaced the New York subway with such revolting graffiti may be the best reason not to consider it --- or the response --- to be a partisan issue.</p></blockquote> <p>It turns out while he was a poor friend to Israel and <a href="http://www.truthrevolt.org/news/dershowitz-obama-stabbed-israel-back" target="_blank">stabbed them in the back</a> every chance he could, <a href="http://theweek.com/articles/568774/why-republicans-are-obsessed-comparing-obama-hitler" target="_blank">Obama was not Hitler</a> despite the admonitions of many on the right. We try to tie it to the other party, the other side --- because our side could never be so vile. If a swastika shows up with Trump scrawled alongside it, it must have been a liberal trying to frame "our guy" and make him look bad.</p><p>The left, on the other hand, thinks, "See? Those conservatives really are evil --- let's get 'em."</p><p>In most cases, the truth is something entirely different. Option C just might be an anarchist --- not a D or an R --- following the same path of destruction that led to Hitler and the Holocaust.</p><p>The evil that possesses someone's heart to threaten or commit acts of violence is not a political ideology, it doesn't belong to a party and it doesn't wear a team jersey. Thankfully, senators like Ben Sasse (R-NE), who joined <em>The Glenn Beck Program</em> on Thursday, are leading the charge to protect the rights of the most helpless.</p><p>"In the legislative domain, we ought to be able to start with things that we can agree on. Americans are the kind of people who cheer for the vulnerable. We fight for minorities. We protect the powerless from the powerful. And a little baby boy or girl that's just been born, fighting for their life, I mean, it's the most basic thing that people who are humane defend," Sen. And it looks as though the press doesn't really care about the anarchy and the anti-capitalists that were out smashing the banks and the Starbucks, like they had anything to do with anything.  Starbucks, where you sit and have coffee and discuss Karl Marx.  Why are you breaking their windows?  What have they done?</p><p>Oh, I remember.  You're upset at Donald Trump and his Muslim ban, which isn't a Muslim ban.  Got it.  Got it.</p><p>But wait a minute.  Didn't Starbucks say they were going to hire 10,000 refugees?  Oh, that doesn't matter.  Go ahead.  Burn them down too. Because you don't really care.  You're for chaos.  You're for burning the whole system down.  </p><p>And who are you protesting? You're protesting another guy who wants to burn the entire system down.  You two should unite.  You two should get together.  You two should go on the road.</p><p>Maybe you will.  Maybe Milo could go from place to place, college campus to college campus, saying horrible, despicable things, and you can fall right into it.  Because all he's trying to do is create chaos.  That's what he believes in: chaos.  Burn the entire thing down.  None of it works.  A nihilist.  </p><p>Then you can actually, in protesting a nihilist, become the nihilist yourself and burn it all down.  And then the regular people will stand around saying, <em>Somebody has to make that stop.</em>  Because the world has been turned inside out and upside down, and the top will come crashing down to help you.</p><p>Geez, where have I seen this before?  </p><p>I can't take 144 characters anymore.  I can't take Facebook anymore.  I can't take talk radio, where we have three hours to converse.  Because there are those who will listen to two minutes of what I have to say, that might take me 20 minutes to fully explain and understand, and you're off on Facebook.  You're off on Twitter.  You're off making a meme, to make sure that you can dump more poison into the system.  Isn't this great?  America, this is what it's all about.  This is the land of the free and home of the brave, isn't it?</p><p>Look how brave we are.  We can all sit behind our little memes.  We can all sit behind an avatar and a fake name, and we can produce a fake life.  And we can take pictures of just the good parts of our life so we can show everybody how great and cool we are. Boy, we are the home of the brave.  </p><p>The young face of the alt-right, the 31-year-old Breitbart writer (what a surprise), known as the "dangerous faggot," has quickly become a hero to young conservatives and Libertarians.  Why? Because he punches back twice as hard.  That's why.</p><p>He's neither a Libertarian, nor a conservative.  <em>Well, Glenn, how could you possibly say he's a racist? Oh, my gosh.  He's a homosexual who has dated black dudes.</em>  Oh, you're right.  (Hey, by the way, you should come over sometime because a friend of mine has this whole collection of letters that Goebbels wrote to his Jewish girlfriend. But you're right, you're right.) But wait --- <em>The Night of Long Knives</em> --- I'm trying to remember, how many SA commanders were caught in bed with young men?  I'm trying to remember.  That number was zero. He's got bleach blond hair.  He sticks his middle finger up to the establishment on the left and the right.</p><p>He's connecting with the 18 to 34-year-olds.  He warns the GOP, <em>You're alienating not the old voters, but the next generation of conservative firebrands who are currently gravitating to Trump, the alt-right and Milo.</em> </p><p>He's the guy who wrote for Breitbart the 3,500-word piece, <em><a href="http://www.breitbart.com/tech/2016/03/29/an-establishment-conservatives-guide-to-the-alt-right/" target="_blank">An Establishment Conservative's Guide to the Alt-right</a></em>.  Although, initially small in numbers, the alt-right has youthful energy and jarring taboo-defying rhetoric that has boosted its membership and made it impossible to ignore.</p><p>This movement is young, and they defy all the taboos.  And unfortunately, the alt-right has become impossible to ignore.  Because it's racist.  But I don't mean racist like the left does, where merely being white and male is a sin.  I mean rationalizing, what, you're intellectually or culturally superior because you're white.  I mean believing that black and brown people are less valuable society and should be viewed with contempt.</p><p>Is he racist?  No.  He's dated black dudes.</p><p>Even though the alt-right will openly crack jokes about the Holocaust, express its outrage of race mixing, they do have real problems with race mixing, writes Milo.  And that's only because anything associated as quickly with racism and bigotry as the alt-right will inevitably attract will racists and bigots.  The alt-right intellectuals would also argue that culture really is inseparable from race.  There's a difference.  </p><p>And we're in the "we" generation now, and this is what happened in the 1930s.  This is what happened during the French Revolution.  The "we" gets together and either says, <em>We're better than this.</em>  and they understand who they serve.  And they serve a loving God that teaches peace and comfort, decency, honor, charity, love, or they serve a God that says, <em>Tear it all down</em>.</p><p>The ends justify the means.  Darkness is good.  Dick Cheney, Darth Vader, Satan, that's real power.  That's Steve Bannon's quote.</p><p>Does this sound familiar at all?  At least a tip of the hat to the world's first rebel who rebelled so well that at least he won his own kingdom, Satan.  That's Saul Alinsky.</p><p>We have been poked and prodded. Right now, Donald Trump is having a war with CNN.  Well, I've seen this before, except the press didn't report the last time a president did this, and it's just been ratcheted up, but it's the same exact war.  Donald Trump has been saying, I don't watch CNN anymore.  It's all fake news.</p><p>Gosh, I remember somebody else saying that about Fox News.  Who was that?</p><p>See, I was there.  I was there when we were effectively taking on the Obama administration.</p><p>And first, the pressure started coming up from the office of Roger Ailes.  <em>Hey, we all love the Constitution, but, you know, there are things that we have to do. Hey, you know, you're kind of speaking out against the GOP  Hey, we're starting to get a lot of pressure now from the White House to our White House reporters, our White House reporters aren't really getting access.  Don't ever say you like our White House news reporters.</em> </p><p>See, I was there.  I saw that pressure.  I saw how that worked.</p><p>So Trump isn't doing anything new.  Trump is just taking it up one more leg.  One more rung up on the ladder, because he learned what worked from the left.</p><p>And the press was quiet and complicit.  They don't believe in freedom of speech.  They believe in the freedom of speech that they like.  The First Amendment is worthless, unless you stand by the speech that you despise.  No university in this country is worth their salt, unless they can say, "Yes, Milo can show up.  Milo can speak."</p><p>How do you even know what you like, what you despise, who you are, what you believe, if you won't even listen to the other side, except for maybe in 144 characters? Any time somebody tells you not to watch it, not to listen to it, not to read it, by God, that's the first thing I do. I read, I watch, I listen.</p><p>I know why Hitler was so bad.  Not because I watched some stupid documentary.  Because I read <em>Mein Kampf</em>.</p><p>I know why the alt-right is poison.  Because I've read Aleksandr Dugin.  I recognize who Milo is.  I recognize what Steve Bannon is.  I recognize the tools that they're using and why they're choosing each word.</p><p>Because I've read the horror show and the manual that they're currently using --- and it's not 1933.  It's a brand-new theory.  The Fourth Political Theory.  You don't know what it is?  Oh, well, you shouldn't look into it.  Don't read it.  It's too dangerous.  Don't read it.  It's bad.</p><p><em>Everyone</em> should read it; otherwise, you'll be swept into it.  Because it's going to be mighty popular.  It's found a way to tell you all the things you want to hear in the language that you want to hear it.  Oh, it's going to make you feel so good.  It's going to be so popular. But the <em>last</em> thing you should do is know exactly how it works, why it works and what the ends are.  Let's just <em>hope</em> for change.</p><p>I stand against the UC Berkeley anarchists.  You don't have a right to do what you did.</p><p>I stand for Milo and his ability to be heard and to speak without danger.  But I also want to make it very clear:  He is a despicable human being.  His message is poison, but he has a right to say it. And they serve a loving God that teaches peace and comfort, decency, honor, charity, love, or they serve a God that says, <em>Tear it all down</em>.</p><p>The ends justify the means.  Darkness is good.  Dick Cheney, Darth Vader, Satan, that's real power.  That's Steve Bannon's quote.</p><p>Does this sound familiar at all?  At least a tip of the hat to the world's first rebel who rebelled so well that at least he won his own kingdom, Satan.  That's Saul Alinsky.</p><p>We have been poked and prodded. Right now, Donald Trump is having a war with CNN.  Well, I've seen this before, except the press didn't report the last time a president did this, and it's just been ratcheted up, but it's the same exact war.  Donald Trump has been saying, I don't watch CNN anymore.  It's all fake news.</p><p>Gosh, I remember somebody else saying that about Fox News.  Who was that?</p><p>See, I was there.  I was there when we were effectively taking on the Obama administration.</p><p>And first, the pressure started coming up from the office of Roger Ailes.  <em>Hey, we all love the Constitution, but, you know, there are things that we have to do. Hey, you know, you're kind of speaking out against the GOP  Hey, we're starting to get a lot of pressure now from the White House to our White House reporters, our White House reporters aren't really getting access.  Don't ever say you like our White House news reporters.</em> </p><p>See, I was there.  I saw that pressure.  I saw how that worked.</p><p>So Trump isn't doing anything new.  Trump is just taking it up one more leg.  One more rung up on the ladder, because he learned what worked from the left.</p><p>And the press was quiet and complicit.  They don't believe in freedom of speech.  They believe in the freedom of speech that they like.  The First Amendment is worthless, unless you stand by the speech that you despise.  No university in this country is worth their salt, unless they can say, "Yes, Milo can show up.  Milo can speak."</p><p>How do you even know what you like, what you despise, who you are, what you believe, if you won't even listen to the other side, except for maybe in 144 characters? Any time somebody tells you not to watch it, not to listen to it, not to read it, by God, that's the first thing I do. I read, I watch, I listen.</p><p>I know why Hitler was so bad.  Not because I watched some stupid documentary.  Because I read <em>Mein Kampf</em>.</p><p>I know why the alt-right is poison.  Because I've read Aleksandr Dugin.  I recognize who Milo is.  I recognize what Steve Bannon is.  I recognize the tools that they're using and why they're choosing each word.</p><p>Because I've read the horror show and the manual that they're currently using --- and it's not 1933.  It's a brand-new theory.  The Fourth Political Theory.  You don't know what it is?  Oh, well, you shouldn't look into it.  Don't read it.  It's too dangerous.  Don't read it.  It's bad.</p><p><em>Everyone</em> should read it; otherwise, you'll be swept into it.  Because it's going to be mighty popular.  It's found a way to tell you all the things you want to hear in the language that you want to hear it.  Oh, it's going to make you feel so good.  It's going to be so popular. But the <em>last</em> thing you should do is know exactly how it works, why it works and what the ends are.  Let's just <em>hope</em> for change.</p><p>I stand against the UC Berkeley anarchists.  You don't have a right to do what you did.</p><p>I stand for Milo and his ability to be heard and to speak without danger.  But I also want to make it very clear:  He is a despicable human being.  His message is poison, but he has a right to say it. Who is he? A Puerto Rican nationalist and one of the leaders of FALN (Fuerzas Armadas de Liberación Nacional or Armed Forces of National Liberation)," Glenn said Wednesday on radio. </p><p>In 1981, Lopez was convicted and sentenced to 55 years in federal prison for seditious conspiracy, the use of force to commit robbery, interstate transportation of firearms and conspiracy to transport explosives with an intent to destroy government property. In 1988, Rivera was sentenced to an additional 15 years for conspiring to escape from Leavenworth. He was one of the 14 convicted FALN members offered conditional clemency by Bill Clinton in 1999, but rejected the offer. </p><p>"Let me tell you how bad this guy is," Glenn said. "In 1980, a robber breaks into an apartment. He's so freaked out by what he finds, he goes to the police and says, <em>Hey, I want to tell you something. I was trying to rob this guy's house. You guys need to know what I found</em>."</p><p>What did he find?
