Texas man beats daughter’s molester to death

Imagine you’re a father and suddenly heard your four year old daughter scream in the distance. As you raced to her aid imagining all the things that could happen to her on a farm to make her yell for aid – would you think for a second that someone could be sexually assaulting her? And when you finally found her to help and you found yourself face to face with her molester – would you be able to contain your anger while trying to stop him? Those are the questions that were raised on the radio show this morning when Glenn read what has to be one of the more disturbing stories to come across his desk in quite some time. Glenn, Pat, and Stu debated the story and the emotional fallout on radio this morning.

The Blaze reports:

A Texas father beat a man to death after catching him molesting his 4-year-old daughter in a horse barn, The Houston Chronicle reports. The incident happened Saturday evening near Shiner, Texas.

Lavaca County Sheriff Micah Harmon identified the deceased as a 47-year-old man from Gonzales, Texas. He was reported dead at the scene, however, his name will not be released until his next of kin is notified.

Harmon said the father and daughter were with several other people at the family’s barn to groom and tend to the horses, according to The Chronicle. The alleged attacker was reportedly an acquaintance of the father.

The sound of the little girl’s screams were later heard coming from the barn and instinctually, the father rushed to his daughter’s aide. After reaching the barn, he found a man sexually assaulting his daughter – undoubtedly a dad’s worst nightmare.

After pulling the attacker off of her, the father repeatedly struck the man in the head.

The young girl was taken to DeTar hospital in Victoria where doctors ran tests to determine whether sexual assault had occurred, The Houston Chronicle reports. She was eventually released.

“I don’t think this guy could have stopped.  Would you?  Can you imagine walking in and seeing your four-year-old daughter being molested by a guy,” Glenn said. ”I don’t think I could stop myself.”

“God bless this family.  Pray for all of the people involved.  Pray for the soul of the guy who’s gone man.  But pray for this family.  God bless.  The father and the mother and the little girl.”

    If someone, in any way harmed one of my children, they would never find a body. If I was unable to get at him/her and that person got into the hands of the police, I would be waiting with a rifle. If he she was released on bail pending trial, nobody would ever find a body.     In Texas, the father has a chance with the legal system. If it was a liberal state he’d get life for killing a Democratic Party constituent!

    Not knowing all the facts, but based on this limited account, I honestly don’t know how i would have responded. Clearly getting the attacker to stop was the right thing to do. Beyond that I just can’t say. I imagine, some day, the daughter will hear the whole story, hopefully she will be spared the memories till she can deal with them: hearing her Dad killed the attacker could actually be worse for her. I would never condemn the Dad. Not being religious, but spiritual, I could only hope that I would have been able to stop myself short of killing, but I honestly don’t know. I do know the situation is horrible and thank God the Father was nearby to intervene.

    If I caught them before the police, I would quickly dispose of them and no body ever found
    If after the police found and all that BS  they would not make it to the bottom of the court house steps.  If I could I would do it in such a way as to not get caught.  But even if I were caught and found guilty I consider a few years behind bars to get this off the streets, to make sure my child was never in fear from that person again, nor would any other child.

    My dad caught my uncle (his brother) molesting me when I was that age. I don’t know what he did (I don’t remember), but my uncle never touched me again. I think the father should not be prosecuted for his actions. As someone else before me said, this was not murder…it was self defense, or in this case dad defense of his little girl.

    It was a crime of passion. He didn’t premeditate or go get a gun. He fought with his fists like a man. The anger he felt is what caused the death. This will go to the grand jury but there is not a jury in Texas that would convict him. Hope Holder stays out of Texas business. I am sure Obama lost a voter with this death and the DOJ won’t like that.

    Judge can’t sentence him. the grand jury has to true bill him if they think it should go to trial. Any grand jury knows there isn’t a jury who will convict, not in Texas.  Texas has “crime of passion” defense  this is a “crime of passion”.  If he were in Washington state or somewhere like that..i dunnu what his fate would be.

    Like most of us that love our children and would do anything for them.  I found what this father did to be a no-brainer.  Had the justice dept. been allowed to handle this case the trial would of been a fiasco and the outcome more in the deviates favor, because of some kind of past problems, this poor man had been expoused too.  like watching Happy Days, or Roots, or some other bull the defense would come up with.  The father did the right thing in the heat of the moment and should be given the best defense, protecting his daughter, is the love of a father for his child,  that never gets old.  defending the slime would be a waste of time.

    In the Torah, rape is a capital crime.  Rape kills the person’s most basic identity – gender.  Humans cannot think outside the box of gender; just look at all the hoopla abt sexuality in the news of late.

    I have worked w/rape victims, male and female.  They will often indicate that they feel as if they were murdered but are still walking.  Those who do recover are never 100 percent of the woman or man they had been before the rape.

    I’m not sure he intended to kill the dirtbag, but this is a perfect example of temporary insanity.  He was soooo horrified at what he witnessed, he couldn’t stop himself. (nor should he have!)  You don’t have to have children of your own to relate to what the father went through, when he walked in the barn.  People, of any gender, who do this to children should be left in the middle of the interstate with a sign telling traffic what they have done. It would save the taxpayers a lot of money.  There aren’t enough bad things you can do to them to make up for what they have done to the child.  Christ himself said it would have been better if a millstone were tied around their necks and cast into the sea for harming one of the children!  This from GOD himself!

    my Dad, rest his soul was a cop in NY and he always said when they would run a rap sheet on someone they would see say a burglary charge in the south the guy did 4 years; assault 3 years; etc. When the charges where brought in the NE it would be; burglary 3 months; assault suspended sentence etc.

    We don’t know how many times he hit the dirtbag.  Once, placed in the right place, could do it.  Even if he kept beating, from rage, it might not have killed him immediately.  It says in the original article, he died from his injuries before the authorities got there.  The father may indeed have stopped himself.  Still is a justified killing in my mind.

    This Hero Dad did exactly what any loving parent would do. He saved a lot of money being paid to the courts and liberal lawyers who would try to get him off. If he did go to jail society would house him for a number of years and then he would be allowed to molest again. Think of the innocence lost of that poor young child.

    I believe that anyone caught in such an act “red-handed” should be terminated immediately……

    Im a mother of three, a beautiful 9, 6, and two yr old.  As a parent you always hope for the best and fear the worst.  We live in a wonderful small Christian town but even so you know in your heart that evil rests in mankind.  My biggest fear is anyone taking away my children’s innocence which can NEVER be restore.  So yes anyone who would say they would not do the same thing and protect their own is either a liar or just not right!  If it does not come naturally to you to protect the innocent than you really need to do some soul searching!  Our children is where all of our longevity ends. And for the love of God if we are not “allowed” to protect our own children then EVERYONE really needs to reexamine our purpose on this planet.

    The Amish is a way of life. They are who they are. You can’t expect what is not the norm from others. The man who fought the predator who was molesting his four year old daughter did not fight to kill him. He fought to protect, the vermin was killed, yes, not by intent.  The day a father does not react to his child being harmed is a sad day and a dispicable one. You say “act swiftly and wisely, don’t just react”.  Some crimes do not allow for anything but reaction. Basic human instinct is to protect the weakest and a fathers instinct is to defend his family.

    I believe that sexual predators are worse than murderers. They leave a person in pain and damaged for life and usually get very little punishment if ever caught at all. Yes, I would do the same, but since I’m a small female I would shoot him.  I think that all true sexual predators should get the death penalty.

    Wow for the first time I have read to comments section on one of Glenn’s stories, everyone is on the same page.  Finally something we can all agree on, WE HAVE THE RIGHT TO PROTECT OUR CHILDREN AND LOVED ONES.  Would I have done the same thing? I don’t know of a parent (Father, Mother or Grandparent) that would not have done the same.  This is one law in Texas that should be a Federal law.  
    Was this politicized? No!  It was reported and then commented about.  Is it true that the Father, who is a hero to more then just his little girl, would have been arrested and charged in some of the liberal states?  With out question.  That is not political, just facts.

     Kate, reading your post, I had an epiphany! Just as high taxes can drive the wealthy to move to low tax states, tough criminal sentences can drive criminals away as well! Here’s how it could play out – conservative states could ramp up criminal sentences, drive criminals to liberal states, liberals get mugged by reality and become conservatives!

    Every parent knows the difference in their child’s call. Having been raised on a ranch and my children as well. We knew the difference between our children calling Mom/Dad and it was to let us know there was a leak in the automatic water tank and the Mom/Dad call from terror or pain. The later causing you to feel like you cannot run fast enough to get there. All kinds of things rush to mind. Have they been stepped on or kicked by an animal, snake or scorpion? You don’t know what is happening but you KNOW that cry was because they need you and need you RIGHT NOW! Thankfully my worst was a rattlesnake in the feed room and my daughter couldn’t get out the door. However, if I had come to the feed room door and found this sick POS raping my baby. I don’t think either myself or my husband would have thought about how hard or how many times we hit this sick piece of garbage to get him away from our baby. I just pray for God’s comfort and healing for this family. Unless someone outside of Texas gets into this the family will be left to heal in peace.

    The crime of  “Murder” is very specific in that it requires the prosecution to show the suspect had “Malice” at the time of the act.  At the worst this incident might justify a charge of “Involuntary Manslaughter” which requires no intent or malice.  Please, for the sake of this guy change your header from Murder to Assault.

    I am a native Texan. It is a crime of passion. Crimes of passion are crimes of instinct and don’t simply apply to catching your husband or wife in bed with another person. Adrenilan is why this vermin died, their was no intent to kill. If the dad went into the house and got a gun came back and shot the guy it would be murder. Crimes of Passion are a legal defense here. And this is a text book example. Besides he will be no billed by the grand jury. ALL cases that involve death at anothers hands go to a grand jury to determine if there is cause to prosecute whether the police file charges or not. Home invasions, obvious self defense killings, etc..all.. go to a grand jury where they are always no billed.

    Well, it looks like in this case there were possible mitigating circumstances — the father walked in on the assault.  One could argue temporary insanity, or a heat-of-the-moment response.  Had the assault occurred and the father, upon learning of it, sought out the perpetrator and killed him, then he would be guilty of 1st degree murder.  I would question how long the “beating” took. Was there a moment for him to pause and consider his actions (this can occur even during the act).  If so, the father should have stopped.

    I admit I don’t have children of my own, but I do have nieces and nephews who I dearly love.  The thought of anyone hurting them sickens me, and I’m sure I’d want to kill the s.o.b.

    But we have a Constitution and we have a set of laws which govern our society and we cannot allow anyone, no matter what the circumstances, to take the law into his or her own hands.  To do so violates public trust in the system.  Imagine if each of us sought our own brand of vigilante justice against perceived or real harms.

    This man, no matter what his alleged crimes, deserved his day in court. The right to a fair trial was something the Founding Fathers must’ve felt pretty important.  

    And btw, before I’m accused of being a bleeding heart liberal or anything, I happen to be a strong Conservative and staunch supporter of the death penalty.

    Murder: the unlawful killing of a human being by another human being with malice aforethought.  The key element in this case would be malice aforethought.  Believe it or not, this can occurr during an act of self-defense (say you’re able to fend off a mugger, but then even after he’s stopped his attack on you, you continue the attack on him. You become the aggressor and are guilty of a crime).  I agree “murder” is not the word I’d choose, but rather “killed”. There’s no indication that the father was found guilty of or even charged with murder.

    This is a remarkable assessment.  We do have a State Constitution. We have State Laws. The man acted within those laws. I doubt he will have “a day in court”.  If you choose to use a word, know the meaning. “Vigilante” is not applicable here. There will be no trial if he is “no billed”. May I remind you that each State is seperate and each State is governed by it’s own State Constitution and State Laws. So you can take you Federalism and one size fits all mentality and stick it where the sun don’t shine..

    I don’t know about you but under the circumstances I believe that I would have had enough rage that time would not exist.  To say that the father should have calmly beat the cr@p out of this guy then call the police is a stretch.  A father would have had all his instincts going to protect, anger, disgust, revenge, hatred, rage, all going at once along with adrenalin.  In short no charges against the father and he did us all a favor.

    Most anything we say here would raise the ire of liberals who would give just a good scolding and stops just short of a hand slap.

    Actual memories generally start before age 4 and bad memories, even partial ones are carried for the rest of their lives. Imagine living with memories of molestation for 80 years.

    My “dream/premeditated” choices of punishment for someone who molests my teen grandchildren, would be a 4X4 board 8 feet long and testicles staples to inside a burning barn. Or testicles hung over a tank of piranha.

    In real life, most of us would do much the same as this dad did, within our physical limits. While each suspect “deserves” due process, to be caught in the act by the parent swift justice is preventative measure that likely saves many more children.

    One cousin was kissed by a school bus driver. When word got to her 6’7″ 275 lb farmer Dad, it took the local police force to prevent a giant spear of flesh across the municiple building. Under liberal laws most molesters think they can get away with their games with underage children. When they get caught they cry, “I was abused”. Sadly, once they have hurt these children, most of us don’t give a damn about the voices in their head that gave approval for what they did, nor should we!

    I think the father had no chocie, it’s not like he learned after the fact, found the guy and had time to process all of what happened to his baby girl, he was right there and I dont think any parent should hold back, can you imagine how the child will cope now, her hero is her Dad and it should be, if he didnt react with the animal instint towards its offspring she might not be able to wrap her mind around it all and God only know how the rest of her life with men would unfold. He took a horrible man out of the equation for her and replaced it with honor protection and love as well as removing that evil from the gene pool.

    if faced with a similar situation with some one as a victim in their own family. There were some

    who said it should have gone through the justice system.  Many didn’t think too highly of that.

    I don’t think it is justifiable homicide. Why did he beat him? To stop him? Or was it rage taking over? There seems to be a little confusion in the GB room as to the reason. If it was rage, he needs to be prosecuted for murder. If it was to stop him, how many punches are needed to stop him? Did he just hit him one super-punch, which knocked him off his daughter and also killed him? If so, then it is justifiable. But did he instead knock him to the ground and continue to pummel him until he was dead? Then it is not justifiable. The question is not, what would I do. The question is, what is legal, what would G-d say? If he had a pair of scissors and clipped off his ear, it would probably stop him too. Was it necessary to kill him to stop him or not. If the answer is yes, then it is ok. If not, then it is murder.

    Obviously your attempting to analyze this situation logically, and I agree, logic is something that should drive most of our thought. But the sad truth is logic is not always at the forefront when dealing with our legal system. I can’t help think of the book “A Time to Kill” by John Grisham, It makes you think (after you lose your stomach), what this father did was totally necessary and very logical.  I’m not sure about the part that referred to clipping his ear off with a scissors, but I’m thinking of something else he could clip off that would be totally justifiable;)

    I have lived in many states but always come back to Texas because I feel this is one of the only states where I can carry a gun to protect myself without having to deal so much bureaucracy. I am also proud of our Justice System that they didn’t charge this man for protecting his baby girl.

    Based on the sadness of the situation … I can’t say it’s a wonderful situation or what the father did was wonderful.  I would have done what he did … and he did the right thing … but it is a lose-lose situation.  Daughter will have baggage for the rest of her life from the molestation and then from the violence that followed.  I am glad that this guy will not be getting out to re-offend in 3 years … but the situation is very sad all around.

    I am so proud of the father for rightfully defending his child with killing the molester that was attacking his child.   I wouldnt  know a sane loving parent who wouldnt do the same thing if given the same circumstances.  I only hope and pray the law protects him and not the horrible monster who was committing the haneous crime against a small innocent child .   It is ridiculous that there is even a question or hesitation for that.  It seems sometimes the law protects the guilty offenders more and doesnt protect at all the innocent victims that didnt ask for the crime in the first place and usually the innocent victims and their families are the ones that pay with their lives.  If you dont agree then you have never been a parent or atleast a loving parent of a precious child that is truly a gift from GOD.

    My ranch is about 10 miles from where this incident occurred. The father is a citizen of Mexican descent. The sexual molester was living in Gonzales, TX & is also of Mexican descent, but they can not find any of his family. Reagan, spends 20 yrs in a hospital and now close to being released.  Convicts have it better sometimes while in prison than where they came.  Prisoners have health care which is better than many law abiding free citizens.  A host of luxuries they didn’t have on the outside, etc.  You have different treatment of crimes whether in a “blue” or “red” state.  There is an obvious discrepancy between the treatment, sentence and outcome of a crime whether committed in California or Texas, Louisiana or New York…The system is flawed, and mostly due to ideology of the state in which the crime was committed

    I am sure I would be shocked, stunned, but I would hope not so shocked that I wouldn’t be able to protect my child or any child at my own possible peril. I think the father should be rewarded for his defending his child and I suspect he would have reacted in the same way for someone else’s helpless child, a defenseless person in great harm.  Our laws, which are not enforced, are so soft against crime that pedophiles get away with a slap on the wrist if that, and furthermore they often hold very important positions in our communities, such as coaches, pastors/priests, teachers, lawyers, politicians, etc.

    IF that was my child I would kill him to and I’m only a stepmother. I was molested when I was 9 by a 16 year old boy but nothing was done about it because there was not enough proof.

    Well, I heard about this unfortunately event that will change both families forever from my sister-in-law who was quite sadden by this sick betrayal of someone who has preplanned his attack because as I read he was known by the father and I’m surely to know he was aware of his daughter, this brave little one who scream out for help. I can only say that as a mother the fear of your child being hurt can scare you into a mental blindness to protect your babies, I can bank on it that  what happen with this father as he heard his daughter scream the emotions of surreal overwhelm in fear. Fear can honestly rage you when you’re scare your sense of emotions has been force to attack not aiming to kill but simply to protect think about it before you judge.     I have thought quite a bit about this and I can promise you, my Daddy would have done the same thing.  The article said they are awaiting the autopsy results for “cause of death”?  REALLY folks, you are gonna let them spend your county money to determine which blow the Dad landed that actually killed this sick s.o.b.?  REALLY??????  Just enforces my thoughts – gooooo cowboys!!!!!!!

    I cannot imagine what this family will go thru in the years to come, taking a life, no matter how sorry a life it is, haunts most folks, but I say he saved the Texas taxpayers money and a whole passel of little girls alot more heartache!

    Thank God the little girl was able to scream, she could of had her little mouth tapped..I would of reacted the same way, but really at the end of the day, no one wins. Very sad.  If it had to happen thank God it happened in TX, daddy will not do any jail time!

    I feel sorry for this father. He is going to have to go through life knowing he killed this man. That can be as hard on a man as the crime was. I also think this creep got off easy. He should have been sent to jail for life, but that will never happen. I agree the father was justified in doing what he did, I just hate to see he have to suffer because of this creep.  I pray for the little girl and her father and what each is going to have to carry through life now because of this creep. I just hope both can find some peace after this is all over and all the press dies down……… Personally I am to old to beat this guy to death, I would have just shot him……..

    arghhhh. as a father I would have done the same thing, 100% justified action.  I don’t care what side of the political spectrum your from, I think any father would have done the same thing.  Hopefully the media and the courts will be respectful to the family and let this matter get sorted so they can move passed it.

    The pedophiles and American Civil Liberty Union will protest and say this is a hate crime and will use the liberal media to push the law enforcement agency to prosecute him. The FBI will see if the dead pedophiles civil rights were violated. Then Obama will claim that the dead pedophile could have been his brother. The father will be brought up on charges and the liberal press will find some nice old pictures of the dead pedophile and will find ways to smear the good name of the father. The father will be found guilty and go to jail. The dead pedophiles family will sue the father for pain and grief. The father will lose and will have to sell his farm to pay the dead pedophiles family. The little girl who was molested will have to deal with her assault, be emotionally scarred for life, live her life without her father and homeless. The dead pedophiles family who didn’t really care about the dead pedophile anyway will spend the money within the year.

    Kudos to the father.  He is a hero.  He had every right to do what he did.  The father was defending his daughter.  I do not think he will be charged.

     I know what you are saying and agree with you, but there is also the case that someone is so upset that they cannot think clearly and continue beating someone and can’t stop themselves. This kind of thing happens when something REALLY bad happens to you or someone you love. It’s not that you know what you are doing, but that you simply can’t stop yourself because in short you’ve gone nuts for a little while. When someone is not able to control their anger because of this kind of crime, you can’t call it murder or anything even close to murder, it is simply a killing because of a defense situation and in this case this father was defending his daughter from being raped by not only someone he thought was a friend, but a 47 year old man that is way past old enough to know better. To have a trusted friend defile your family like this set him off and he just went nuts. I can’t say as I blame him one bit. I can’t say what I would have done in his place, but I can guess that I would have done the same thing. It’s also not how long you beat someone when you are hitting them in the head, but where and how hard. It could be that the beating didn’t last very long, it was just where and how he hit this guy. You can’t really say unless you were there and you can’t say what is wright and wrong or what you would have done unless it happens to you.

    The Glen Beck conversation regarding what you would do if you came home and your wife had a molester (whom she had caught molesting your child) locked in a room and then told you of the situation, made me think of the woman who shot the man who raped her daughter at his trial.  I applauded the mother that day and I have given a lot of thought to what I would do in the same situation.  I am sincerely afraid that I would have done the same, I’m not saying it’s the righteous thing to do, but I think only God could stop me.

    Whether there is a cure for a molester or not is not the issue. The correctness of an action is determined by the law. If the law is incorrect, then pressure needs to be brought to bear to change it. However, as long as the law is that one can save one’s daughter but cannot execute justice, because that is the province of the court, such uncontrolled behaviour can be deemed wrong. However, if the law allows for berserk fathers, then the law has made it justifiable.
    I am a father of a six-year old daughter. I am a big muscular fellow and I probably could have removed this molester-predator too. But I would not have killed him. Even if he would never change his evil ways, I have no authority to kill him. The only authority I have is to protect my family and anyone else, but not to kill. So far the law does not execute child molesters. Therefore, I certainly cannot kill him. Even taking the law into my own hands will only authorize me to do what the law prescribes.

    If she was my daughter does not have any bearing on the issue of whether it is correct to kill him. Even if I would have killed him does not make it correct to do so. The law is not drafted, nor executed on the basis of emotion. Such action belongs to the era of lynching. And not every lynching turned out to be justified. Cooler heads must prevail. Otherwise we would have an Arab Spring in America.

    I regret that one cannot visit one evil on another. While it is understandable the rage generated by this action one must only detain the perpetrator of this heinous crime. Clearly, this perpetrator was appropriately detained. Justice would appear to have been served, but the beating is also wrong because the perpetrator died. The perpetrator needed to be treated for his disregard for the abuse he inflicted on this innocent child. If rehabilitation is possible, and I think the jury is still out on that, the perpetrator needed to be treated for his mental deviance and disregard of personal boundaries. No one really wins here, the dad just feels a little better; his daughter will not be helped by the death of the perpetrator. How can his daughter be helped? This seems the more important issue. I cannot rejoice in the death of the evil person, I can, however, pray for the vicitms and the perpetrator.

    I DO NOT BELIEVE IN CAPITAL PUNISHMENT, but when a father or any parent responds to the immediate abuse of their child or loved one – I consider this JUSTICE SERVED.  I hope the parents will get the support of his community – but I’m sure if this dad has to serve time he will do so with pride and I doubt if there is a person in the world that would condemn him. This is an immediate reason, not premeated murder.

    I know that I’m a lone voice in the wilderness here, and a rare naysayer about the idea of the father having killed his daughter’s molester, but I have to fall back on the old ‘Two wrongs don’t make a right” in this instance.  The roughing up of the molester on the part of the young girl’s father would’ve been understandable, maybe, but killing the guy is going too far, imho.  The molester should’ve been put in jail, but the girl’s father also belongs in jail for having used excessive force by killing the girl’s molester.
