Kidnapping? Hospital takes custody of teen girl after parents argue against diagnosis

On radio this morning, Glenn reacted to a bizarre story out of Boston involving Justina Pelletier, a 15-year-old girl who has been stuck in a hospital for the last nine months after the medical facility took custody of her when her parents argued against her diagnosis.

“We are talking about the story that is up on The Blaze, ‘It’s kidnapping: Hospital takes custody of a girl.’ Imagine your 15-year-old daughter, you take her in because she has a flu, and you are told you have to get out. And you are escorted out by police, and you no longer have custody of your child because you disagree with the diagnosis,” Glenn said exasperatedly. “And so the parents now, for nine months, have been fighting this. The judge put a gag order, so nothing can get out, which is another thing that is absolutely wrong. That is absolutely wrong. “

TheBlaze reports:

For the last nine months, Justina Pelletier has been sneaking messages to her parents in Connecticut through folded origami notes.

“It is kidnapping,” Lou Pelletier, the girl’s father, told WTIC-TV.

The local news station investigated the case, for which a judge later issued a gag order, and has the background leading up to the ongoing custody battle.

Pelletier was diagnosed with mitochondrial disease a few years ago and was able to live a normal life. In February, she got the flu and was taken to Boston Children’s Hospital to see a specialist. It was at that time the problems began.

According to the WTIC report, new team of doctors took over Pelletier’s case and immediately questioned her previous diagnosis and re-diagnosed her with ‘somatoform disorder’ – a mental illness. Her parents, Lou and Linda Pelletier, were not allowed to take their child out of the hospital and were instead escorted out by security. Within four days, they lost custody of Justina.

“That is absolutely wrong. I have a gag order? It’s my daughter. I’m not going to speak out for my daughter,” Glenn said. “It is an amazing story happening here in America. This is Russia. This is the stuff that used to happen in the Soviet Union, that we used to say, ‘Man, are we not blessed. That’s why this is an evil empire.’”

Glenn explained that this story is particularly important because it speaks to the question of rights. Yesterday, there was a story out of Tennessee involving a father who was arrested for trying to pick his kids up from school on foot instead of in a car. Today, we hear this story of parents who have been stripped of custody for disagreeing with their daughter’s doctor. We need to know our rights, and we need to continue to fight for them, or we are going to see a lot more stories like this one.

“Do you have a right? Who does your child belong to: You or the state? Is the state saying you can parent your child? Look, we will disagree on parenting stuff. We will disagree on healthcare choices. We are going to disagree. But if they’re not insane and they’re not abusing the child, I make the case that this is a kidnapping. I make the case that this is a re-education of this 15-year-old child, and it is absolutely wrong,” Glenn said. “Why does the state have the right to silence parents and put a gag order in when you say, ‘I want my child back. This is my child. You don’t have a right to do this.’ Why does the state have the right to gag you? Could you be gagged?”

“This is a really bad story,” Glenn concluded. “I want you to Facebook this and tweet this story, and get this story out to as many people as you possibly can. It’s abhorrent it’s been going on since February, and no one’s really heard or this story. Nationally, we are not talking about this story.”

    Dear Glenn,
    I am horrified but not shocked by the story. Ironically, I just returned last week from Boston Children’s Hospital with my 12 year old son who has been previously diagnosed with “post viral syndrome” and then Chronic Fatigue Syndrome and now appears to have POTS. We have been along a very difficult path over the last 18 months and have found that when doctors cannot figure out your child’s illness they diagnose them with “post viral syndrome” or now “somatoform disorder”. I found no support from my son’s pediatrician. She has been caring for all of our 4 children since birth. She should clearly understand that we are not alarmists but when our child goes from being the picture of health to being bedridden this is not a psychiatric disorder!!!
    Shame on the team of doctors for punishing the family who is already suffering due to a senseless and cruel illness. Families should be able to reach out to their physicians for guidance and support and should not fear reaching out to them will result in them being “institutionalized”.
    My son was brought to Boston Children’s because his heart rate was soaring to over 200 beats per minute. I was obviously worried and justifiably so. I was informed within a very brief period of time that my son was “stable” but let me add that there was no diagnosis, no treatment and only an EKG to make this determination.
    I demanded that my son get the proper evaluation he should and be looked at head to toe. I wanted to have him re-evaluated for something that perhaps had been overlooked. I now realized that I was skating on very thin ice. We were admitted on a Wednesday evening and by the weekend they had the psychologists, infectious disease, medicine, pain specialists and cardiologists review the case. I thought it odd that they never asked me for all of my previous medical documents and that they did not want to hook my son to the cardiac monitor or even perhaps a holter monitor to better evaluate his variable heart rate. They minimized his clear heart beat irregularities but did start him on some appropriate measures for POTS, as I emailed a specialist to double check their decision. But, by Monday morning the “team” had a different plan that what I thought they had. I believed they were round table meeting to help come up with a great plan to get my child’s life back. Fortunately, I asked my brother and brother in law to help support me, for I feared that I would be “beaten up” by the “team”.
    We met for over 3 hours and I was brought to tears. We were informed that my son was now being diagnosed with the 21st century, politically polite diagnosis “crazy”. “Your son has somatoform disorder” and would benefit from aggressive PT, cognitive therapy and medical management. We asked them to clarify where was the previous diagnosis of CFS and POTS. They assured us that this new diagnosis was in addition to and not taken the place of the CFS and POTS but the “somatoform” disorder was a needed diagnosis to allow insurance to permit “inpatient care” for aggressive treatment. My son would stay in Bader 5 and would be one of 16 children on the floor. Parents would be allowed to be part of and encouraged to be part of the therapy but would not be allowed to stay with their children.

    After an agonizing 2 additional hours, my family, my son’s psychologist of 15 months and I determined that this was not the means of helping my son. That “locking him up” would devastate him and send him the message that we didn’t believe in his symptoms and that I would then tell him I too turned my back on him like the health care professionals. They almost had me at my weakest moment but thanks to my family and son’s psychologist I reached into my heart and knew my son belonged home with those who love him and believe in him. I refused to turn my back and thank God that I got out of that hospital.
    I had been to Boston 4 different occasions and always left feeling frustrated and unassisted. One year earlier one of the rheumatologists very kindly informed me that my son’s condition was “common” and that I should stop “doctorizing” his condition. She failed to mention the diagnosis she considered at the time was CFS/Fibromyalgia. Sadly, in this country anyhow, these conditions are thought by most to be “mental” issues and not “true” issues. It is time for Boston Children’s Hospital and many others to recognize that there are compassionate and knowledgeable doctors who are trying to understand this frustrating “ghost-like” illness. There are actually tests that are “abnormal” for these patients but the doctors need to be knowledgeable enough to know what they are. Just because we don’t see a clearly defined abnormal test result(s) doesn’t mean that a the person is crazy or should I gently and politically correctly say “suffers from somatoform disorder”!!!

    Please stay away from Boston Childen’s Hospital if your child suffers from CFS/Fibromyalgia/Mitochondrial Dysfunction or POTS. Be advised that Dr. Phillip Fischer in MN at the Mayo Clinic understands this frustrating disorder and can be a help for your child, similarly Dr. Julian Stewart understands these conditions and is out to make life better for the children who suffer from these illnesses. Thanks to those of you who truly care and may the right thing happen for the poor family whose daughter is now surrounded by complete strangers who could never love her like her parents!!!!!

    People have been protesting and it all falls on deaf ears. It’s getting to the point where civil disobedience is necessary. We need to start organizing and be ready to be arrested, fined etc. They rely on our fear and will continue to bully us unless we take a stand. Need to start figuring out ways to network with our children’s education, our medical etc. unfortunately, these are going to be tough times for those that are not as healthy.

    This has been happening for years here in Hawaii at the Kapiolani Children’s Hospital. I was called in one night to assist when a pregnant mom went in because she was having contractions a few weeks early and just wanted to get checked. She and her husband were planning a home birth but when the doctor checked her it stimulated labor and she ended up delivering a healthy baby with no issues except that he was an ounce under their “preferred”weight. Mom and dad asked to hold the child and nurse him for a while before taking him home. The hospital staff then said they needed to put baby into the neonatal intensive care unit and run tests. When the parents very sweetly and respectfully asked why and asked if they could just nurse the infant for a while, the doctor said no and a nurse called the police. When the parents informed the doctor that it was against their religious beliefs to have their child “worked on” unnecessarily the doctor responded “I don’t care what religion you are, in this hospital I’m God!” All this was witnessed by others in the room. The police showed up and forced the father to leave the hospital property or be arrested. No warrant, no opportunity to explain He had not shown any resistance and was told he would be arrested if he even said one word. The child was taken to NICU and then put in a faster home for 4 months. The parents were told that if they pursued it or filed a complaint they would lose their child for good. No complaint has been filed.

    THANK YOU Glen Beck for reporting this story and please keep reporting these. Exactly the same thing happened to me and my 14 year old daughter at one the the “best hospitals in the world.” My daughter did have cancer, a very rare cancer and had an unannounced visit to her hospital room right after chemo and in serious pain and ill, a visit from a STUDENT in the psychiatry program who we had never met before and had no history with my daughter. This person decided my daughter needed to be on a couple anti depressants and demanded that I sign the consent forms to start her immediately on these other drugs (on top of her many cancer drugs). I told this person she just saw her regular psychologist and medical team and they said she is ready to go home and no one else has said anything about clinical depression. She just had chemo and was feeling sick and had other side effects and was on morphine for the pain. I demanded a second opinion and to meet with her medical team and regular psychologist before signing and putting her on some other drugs and of this type. I was first lied to by this student that said she had called them all and we were to meet the next morning. The next morning she admitted she had not actually called any of them and refused me that right.

    My daughter did not have a clinical depression requiring these drugs. She had cancer and was handling it all quite well with all her support of her psychologist, friends and teachers and medical team and mom. She was responding to treatment “phenomenally well” as put by her medical team and top researcher on her case. This student person got her way though by calling child protective services and hospital security and the city police. She insisted my daughter be put on the LOCKED psychiatric ward. My daughter was terrified. She and I both knew it would be her demise.

    I was escorted out and told not to return or to try and communicate with my daughter. My daughter was taken from her hospital and medical team and her stem cell transplant she was to have just 2 weeks from the time they locked her up. They took her entire support system from her – her friends, mom, her dog, her home, teachers and school, her life. She died of complications, not the cancer, 2 1/2 months later. It doesnt matter what you take your child in for, it can happen to ANY parent ANY child in ANY situation when you take them to a hospital, clinic, school. I would love to get my story out there and want desperately to start a huge movement bringing parents together to fight against this. It IS happening and more than people realize. Thank you thank you thank you Glen Beck for telling about this.

I would like to know what it is going to take to wake people up – and what can we do about these kinds of things?     It’s very unlikely that the details of this case are exactly as you depicted them. It’s more likely that there are circumstances that you’re not aware of involving the parents’ behavior that caused the hospital to call the police.

    What about *HER?* What is HER opinion? At 15 she should have the final say along with parental input. At 15 one is no longer a child but a young adult who is young enough to need parental input. I remember being 15. (I was in perfect health so there is no real comparison.) As for who owns the child or young adult or any person? Neither the parent *or* the state as no human being can own another human being. When the child is too young to make decisions the parents are responsible for them. That goes with being a parent, but they do not *own* the child. The child as he grows into a young adult gradually takes over the decision making. For the most part a 15 year old can make their own decisions but still there is a lot of parental input (there always will be even if the offspring is 50).In this case: The
    *law?* The law says you’re a baby until 18. THE LAW IS AN ASS.

    Between schools and now this, I’m beginning to wonder if the US is losing its collective mind. How in the world did these fools get to the point where social services can simply take possession of your children because you disagree with a government official? How exactly has the government come to believe that they know better than obviously involved parents how to care for their child?

    The only time that this could be justifiable is in cases of Munchausen by proxy. Even in these cases, it is extremely difficult to prove that this is occurring, especially in light of the fact that this girl has not improved under their care. This team of doctors truly seem desperate to keep her from her parents because they dared to be involved in her care and did not meekly accept whatever mind altering medications they decided to pump her full of instead of treating her for a real illness. Note that the court did not even consult with her long term psychologist, they would only act on the recommendation of a team that likely does not even exist in the same form now. This is madness.

    The question is why? Why is this girl still there? If so , why are there still anyone standing in the way of this father getting his daughter back ? Why is the “judge” still breathing our free air? If this was my daughter I would tear down that so called hospital brick by brick to get her back.

More often than not authority figures are resorting to totalitarian actions because they no longer have either the law or common sense to support their wild need for control.     In the State of California, many years ago, I lost a stepdaughter to Leukemia because the State decided she was old enough, at 15, to make her own medical decisions, since age 15 was the age of emancipation there. Perhaps this girl can ask for a hearing for emancipation, and if her parents agree to it, she can check herself out of that hospital, so long as the law is similar in her state. In my Stepdaughter’s case, she was 15, obese, had very low self-esteem, and had told me on a visit, shortly before she became ill, that if it wasn’t against GOD’s laws she would commit suicide. Then she contracted leukemia, and her Mom, altho not a member of the Jehovah’s Witnesses, raised her kids to believe the same concepts. My SD then, at a hearing her Dad and I pressed for, while she was in the hospital refusing treatment, hoping to be able to legally influence her healthcare to preserve her life, LIED to the judge and swore she hadn’t told me that! Thus, because of emancipation laws, she was declared old enough to make her own medical decisions, and because she was lied to and told that if she took a blood transfusion to repair her leukemia she would go to hell eternally, and because she wanted to die, she did just that. The State said she was old enough to decide. It also ruined her father and our marriage, subsequently, since he somehow had pinned his hopes on MY suggestion for the court to intervene, and later, the fact that my children with him were still spared, – yes, weird, but he wasn’t logical… he was heartbroken. -And was never the same after her death. Just ‘Be aware’. Hopefully, emancipation could work in this ‘kidnapped’ girl’s favor. -IF she hasnt yet been legally proven to be mentally ill in court. Otherwise, this is the first publically-shown government kidnapping, sure to be repeated… Zieg Heil, huh. Sucks!

    A resident seldom has that kind of power in any other field of medicine. Psychiatrists and psychologists, I have found, are trying to deal with their own issues by trying to “help” others. They are as crazy as their patients.

Mark my words . . . if the next set of elections (both ’14 & ’16) are dominated by the Democrats . . . our national system of freedoms will systematically be dismissed, as the senate dismissed the constitution earlier today.     The parents did not disagree with a government official. They diagreed with a change to a new diagnosis for their daughter by doctors at a voluntary, non-profit, private hospital. Apparently those doctors have a particularly Leftist version of the egotism not exactly unknown among health care workers drawn to working with children.

    Thanks Glenn, for bringing this to the attention of internet users; it only goes to show so much of the time doctors have it all wrong, but in my experience, I’ve never known them to be treated as Gods, not to be questioned. I know there are doctors you can’t talk to, but that isn’t a problem, find a doctor you can talk to.

    It’s not that simple. The hospital immediately involved a social worker when the parents were resisting a diagnosis that was arrived at in just a few hours. The worst part of it is that this happened in a very short time. Somatic disorder is not usually life threatening. But these doctors not only pushed this new agenda with no regard for the parents, they also never gave them time to adjust to the possibility. There was clearly no emergency, but they literally had to lie to a judge in order to push this new diagnosis, in spite of the testimony of physicians who had been dealing with her case for years. Additionally, the parents are being forced into a visitation situation that is worse than I usually see for cases of domestic violence. This case is ridiculous.

    I don’t care what kind of gag order you put on me, I would contact every type of media I could. You will have to kill me before I would let some hospital do this to my child. Whats wrong with this country. this stuff has to stop. this government is out of control and no body seems to be able to stop them. What happened to the protests of the sixties? They seemed to work in the long run, why don’t we start that again. Why are “we the people” letting things like this happen? Everybody talks about this government, its all over social media every day but no body seems to be doing anything. WHY??

    First we need to start speaking out and stop this in its tracks. There are more people who are against this type of behavior than for it. Don’t cower start standing up for your rights and if you are near someone who is being wronged, stand with them. We need to start a network where people are informed and start boycotting this behavior. If we stand by and do nothing and just hope it turns out alright, we are done. There is still time to turn this around, don’t give up people!

    It is just an example of how a hospital visit can go terribly wrong, just by the state overpassing it’s atributes and trying to ruin a family’s lives, it is horrible that a concerned parent looking for their daughter’s well being ended up like this, but I must said it does not just happens at hospitals, it also happens in schools like it did to us in our daughter’s school in el Paso, TExas, she was a in Pre-K when one day the teacher aproached me saying that she felt my daughter needed to be medicated and she was almost sure that she had ADHD, I asked her If she had a degree in psychology or psychiatry and she was so upset and enraged to the point that she told me my daughter wasn’t welcome in her class anymore If I did not take her to the dr., she would refer me to…I asked her which are the symptoms you observe on her?(since I haven’t seen any) she told me she didn’t know how to be a good friend?? WTH??It took me a long way to pull her out of that school but it was worthy, now she’s a happy 9 year old and hasn’t have any other problems of that matter in her school, and no other teacher or doctor has made the same diagnosis…hope this parents get their daugther back soon!!

    Anyone who would have taken, or held my child against MY wishes would have had a law suit the next day and the press would have been alerted! After I left the hospital and with hours I’d have been back with my attorney! My attorney friend died so I don’t want to sound like I have an attorney on retainer–but I would have gotten one and then I would be at the Governor’s office with the press!!

Institutional kidnapping inside the US because of a parental disagreement has in now way every given grounds for a hospital to be able to remand a child indefinitely. Certainly they don’t have anywhere near the amount of authority to hold her and give her custody over, I want to see the scumbag judge who decided to grant this!

I would be so irate, I would set a plan in motion that would cause me to be locked up for life or 6 ft under as I would leave an example to the government that it should never have happened to my family.     This isn’t something new and not all that unusual. The hospital didn’t do this on their own. They have a legal responsibility to notify authorities if they think the child is being abused and not allowing proper treatment is abuse. DCF came in, had to make the case and take it before a judge. The judge made the final decision and they are not rubber stamps. Often the system is abused but I don’t feel this one is. It may be a difference in opinion between health professionals and I would think the parents could pursue the one they felt was correct. There has to be more to this story. JMO

    Today’s government needs to be feared. My family was in a similar situation with my then-3-month-old daughter. Despite a unanimous opinion by medical staff from two hospitals and her pediatrician, the Illinois DCFS misread one nurse’s statement and ended up denying me contact with my family for a year and a half. They were able to fabricate a story of abuse without any evidence (the nurse upon whose statement they relied testified, under oath, that her initial observations were made without knowing any history and thus turned out to be false) which the judge then believed. We were lied to, not by medical professionals, but by the Illinois DCFS at every turn. It was a horrifying experience that we are still, two years after the case was “closed”, trying to emotionally recover from. The saddest part is that it forces my wife and I to second-guess getting our daughter medical attention, for fear of another fabrication by the all powerful government. That’s only something we can get away from by moving to a freer state, but now we’re into a discussion on the lousy housing market..

    I’m so sorry to hear this story. Some of the best hospitals are teaching hospitals. I regularly go to one and every year I get a “new” doctor, which is actually a student doing their internship. I’ve found most of them very good and they look at things differently, with the knowledge of new procedures. However, last year I got one similar to the person you describe. She lied to me and told me she had done some things she hadn’t. She’d rush through the appointment and I could tell she wasn’t listening to me. We just didn’t connect. I went to the head of the department and requested a new doctor. I got one that I was very happy with and I never saw her again. It sounds to me the doctor you describe knew how to circumvent her resident doctor and went directly to CPS who took her word for the truth. I assume you discussed the issue with CPS and they should have done more investigation and returned her to your daughter’s team’s care. It only takes one bad doctor or social worker, or one who’s too aggressive to do something like this. They are the ones who should be removed.

    This happened to me too, for two days after I gave birth in St Peter hospital in Lacey Wa. They told me I had to stay two days ( as long as the insurance covers) and if I wanted to go home I had to leave my baby with them. They did this because I had a midwife and last minute decided to go to a hospital instead. They had alarms by my room. I was only allowed to feed my baby, and then they did against my will put my child on iv, did genetic tests, then they told me I had to do drug tests, and hep tests and then the vaccinations..they drew blood every 6 hours. I protested and said I wanted to go home, and then they had cps come and talk to me asking me really personal questions. GLENN PLEASE HELP US ALL

    The CDC and the IDSA (Infectious Disease Society of America have been doing this to people with lyme disease for more than 30 years. I was even accused of having Maunchauser’s Syndrome!!!! Now?     Here is how I see it. If and when our child gets in trouble (crime, broken window), we are responsible. When the child gets ill, a doctor can declare a diagnoses, and take the child away from the parents just when that child needs the parents. It is wrong! It happened to me when my so was 7 years old in Atlanta, Ga. .With the swipe of a pen, he became a ward of the state. Fortunately, God prevailed (long story) and I had him home by bedtime. Hew was so traumatized!! Diane, CA.

    I usually don’t comment on articles but your experience touched my heart to write you and tell you I’m praying for your family. We had a very similar experience with my sister: heart beat spiking, fainting, almost bed bound. All the physicians couldn’t diagnose her so they either said everything was fine, blamed my parents, or considered my sister as crazy. By the grace of God we found wonderful doctors at Cedar Sinai Hospital in L.A. They diagnosed her with a heart electrical disorder. They immediately placed a pace maker and she’s been great since then. I’m glad to hear that you advocated for your son.God bless!!

    I think the medical community has got together to drum up disease and illness so they can use debilitating, mind altering drugs on our children and this is a case of that. If the state is awarded custody and their doctor fried decides what is best for the child, including experimental drugs everyone is supposed to be happy. Look a what has happened with all of the cases and ritilin. Look at the testing of drugs on our military personnel. This does not shock me at all. And it is only going to get worse.     Our family has always had medical problems and I TG that we never ran into a doctor remotely like the ones reported here. I’m also grateful that the youngest in the family is 27. If she becomes pregnant I will pray daily that the baby is born full term and stays healthy all her life. Perhaps the fact that my granddaughter and her husband are both pharmacists may dissuade any hanky-panky. These parents should get a lawyer and file so many motions that the gag order becomes meaningless. And when their daughter is released, they should also refuse to pay any ransom—nine plus months of hospital bills will be exorbitant. They didn’t authorize the hospitalization; they should not be responsible for paying it.

    They already had their child taken from them. If it were you, would you risk the case dragging on for even a few months with you unable to take your child home until you proved the hospital and their experts were wrong? What if CPS and the doctors said you were unfit parents because you disagreed with the doctor’s decisions? Threats are very effective if they already have possession of your newborn and have placed him in a foster home. Even if they won after months or years they still would have missed their baby’s life of growing up with them. Would you have risked that with your first child?

The threat was “make problems and you may not get your baby for a long time”. These were first time parents barely making it financially. Stop mis judging and try to think with compassion sometimes.

    This is outrageous! I’ve been hearing other some weird stories lately and I’m beginning to wonder if there is a plan – okay call me a conspiracy nut, I don’t care! – to get as many people as possible on psychotropic drugs? I have a close relative who was given a prescription for Effexor almost 15 years ago because she had post partum depression after the birth of her second child. She has been on it ever since because, well, it’s HIGHLY addictive and she can’t get off. It isn’t even helping anymore and is actually causing depression. She’s constantly in and out of the local psychiatric hospital for about a week at a time and they do nothing but collect the money and feed her more drugs. They REFUSE to even try to take her off the psychotropics because, “She needs it!” Period! Case closed! I’m Dr. Psych and I’m here to help you!

    Grieving Mom, my heart goes out to you. That eff-in student should be prosecuted for manslaughter and be barred for life from practicing any kind of medicine. He/she shouldn’t be allowed to so much as give an asprin to anyone!

    Its not just liberalism. Its everywhere. I work in mental health and it is getting more dangerous. No one has rights past a 1013 order in GA. A lawyer cant get you out. A doctor gets you in and only a doctor gets you out and all you have to do is express depression and not “contract for safety” of yourself. A slip of the tongue is all it takes. This is how they will get us. Those executive orders signed a year ago concerning mental health are way, way more dangerous than was given credit. Just wait until ones faith in God makes you delusional for your beliefs in fictitious character, and then good old home health officials are summoned to your home to clear it of dangerous objects (if you know what I mean).     Be VERY afraid of having to go to the hospital for anything these days. It STARTS with the children and the elderly who can’t defend themselves. Soon you won’t have any rights once you’re signed into a hospital for treatment. I went into the emergency room for chest pains and was admitted for treatment because I had insurance coverage. They waited until 2am to come in and ask me out of a sound sleep to sign papers granting them full authority to treat me as they saw fit. I asked them what the diagnosis was they had so far and they were vague about it but I could ask my physician the next day. I told them NO I did not want any treatment nor surgery and would not allow them to place me on machines to save my life. I would not bankrupt my husband that way. I told them to save the organs for others with worse problems and they could give my “bed” to someone who “needed” it. They had to allow me this decision but I was lucky and haven’t been back to a hospital since.

    I’ve been in healthcare for over 30 years. I am an RN experienced in critical care to home health to Quality and Risk Management and Financial/Revenue Cycle Management. My BEST ADVICE to everyone is : STAY OUT of the hospital. OF course, if you have a TRUE (Life Threatening) Emergency, seek treatment. Otherwise, WISE UP. Healthcare is a BUSINESS. DOCTORS are a business with BOAT payments and million dollar house mortgages. STOP taking your 17 prescription drugs which are killing your liver and understand that over 90% of everything you see a doctor for will resolve itself. You are more likely to get SICKER as a result of being in the hospital than stopping unnecessary Rx drugs. Doctors get paid for PROCEDURES , NOT for teaching you how to stay well.They have no incentive to keep you well. Think about it for half a second.

I have my son being worked with by Dr. Nancy Klimas in FL and she is a huge advocate for CFS.     Most people think that this kind of case is “unusual”…the “exception,” but the harsh reality is that it’s not. It’s just the next level down the slippery slope of “child protective services” that has been going on for decades. To different degrees in different states, many of these cases involve children who haven’t been abused at all, and yet their parents are accused of “neglect” or even (and this is my personal soapbox) “prospective” abuse or neglect. We have been fighting the DCF case from hell for nearly 3 years over allegations that NEVER had ANYTHING to do with any of our children. Based on a 5 year old allegation of abuse by my husband against an UNRELATED child. Yes, I know that any allegation raises red flags, but when there is medical evidence that refutes it, when the accused has passed a polygraph, when there is an eyewitness saying the allegations were false, an alibi, and a child who admits under very limited cross-examination that her mother and grandmother “told me some things to tell you,” it’s time to recognize the fact that there were reasons why he was never arrested or charged with child abuse when the case was first investigated. Instead, I had 5 children removed from my care and a newborn removed from the hospital – 6 children torn from their home for TWO YEARS – who were NEVER abused, based on the determination that they COULD be. One of my children aged out prior to reunification and is now in college. The second has experienced so much emotional damage that she’s been through cutting, being baker acted, and has admitted to smoking, drinking, trying drugs, and getting pregnant twice. And although she didn’t have these issues when she was at home, the state is still keeping her from me because they paid a counselor to say that her behaviors would “likely continue or worsen” if she was to return home. My other children are all with me and have been for some time now; however, I am being forced to live as a single parent, separate from my husband, who can have no contact with my 15, 13, and 11 year old boys, has only supervised visitation with our 2 year old daughter, and yet can see our 7 month old son any time he wants, since no action was ever taken regarding him. My husband’s current “therapist” is just one more in a long line of experts who have said that he’s not a risk to anyone. Child protection is SUPPOSED to protect children from real abuse, abandonment or neglect. But it has become a money-driven business (with a nearly $1 billion a year budget in FL) that either takes children from their parents and adopts them out, or imposes their own parenting standards on families as a condition of “reunification”.

    One of the reasons why it has gone so far, as in the above case, is because most of the media has shied away from reporting the injustices that have been going on for so long, opting to report only the “cleanest” cases of government intrusion. Coupled with the secrecy of child protection proceedings, the kidnapping/child trafficking has been allowed to continue nearly unabated. We’re under the mistaken impression that a parent’s rights will be protected when the case goes to court and evidence is presented at trial. They’re not. Especially in cases like ours, when you get a dependency judge that used to be a senior attorney for DCF. This shouldn’t be a few and far between report of state interferes with parents’ rights in medical decisions; this should be a full-scale investigation into state and court-sanctioned kidnapping.

    How did this get spun to be the current government’s fault? Medical schools have been teaching for decades that if the lab tests don’t show anything, then it’s all in the person’s head. My two siblings and I all have the same health issue, but both my siblings were told (by doctors in WI & CA) that it’s all in their head–in my sister’s case, this was years ago, long before the current administration came into power. Thank God I live in Minnesota. My doctor diagnosed my with probable chronic Lymes, which is another illnesses some of these doctors refuse to believe exists. If I lived in Boston, they’d all just tell me I’m crazy–never mind that I grew up in a tick-infested woods!

Doesn’t matter what state you live in DCS seems to think that they are the state rulers and unfortunately the government let’s them do whatever they please. I live in TN and DCS stole my grandsons. My son was deployed in Iraq when DCS took the boys from their mother but refused to give them to their dad when he returned home or give them to family. I will never get to see my grandsons again as they were adopted out Feb of this year so my prayers are for your family to have a better outcome than my family did.

    Thinking about this more, if the parents are guilty of being hypochondriacs with their daughter, that’s hardly a crime. I can see it being mentally unhealthy to always panic when your child is ill, but hey my ex-wife does that and stuffs my son with homeopathic medicine all the time and nobody seems to worry about that! If however the prior physicians have been abusing their professional responsibility by mis-diagnosing and over prescribing drugs and over treating a healthy child just to make money, there is a serious crime going on.

    Speaking as a newly-minted medical coder, I offer this:

    Subpoena every freaking SCRAP of paper from the attending physician, and have an expert review them. Somatoform disorder is NOT a trivial diagnosis and requires medical decision-making of high complexity, which in turn requires a comprehensive patient history and examination to provide enough data to support the decision-making. Additionally, make sure that the patient record isn’t “templated,” or built from boilerplate language. Make sure the CPT codes (for procedures/therapies performed) line up with the ICD-9 codes (the diagnosis) with respect to medical necessity.

    If there’s ANYTHING out of whack, notify all state agencies and all insurance companies that pay this hospital for services rendered. Any discrepancies aren’t going to be a one-time accident on something this serious. This pattern will recur across the entire practice, because these sorts of diagnoses have high RBRVS (resource-based relative value scale) figures attached, which in turn means that they get a lot of money per patient per day.

    I am NOT saying that there is fraud going on. I’m saying that it needs to be looked for. The behavior of this hospital is way out of bounds. (Yes, I am profiling.)

    The federal government pays all the medical bills for this child. And $7,800 per month to CPS (child protective services). Same thing recently happened to a Sacramento, Ca. family. They had video of the misconduct of the police that abducted their child. Also, try getting a lawyer to help you. They won’t take the case. They will ask for 5,000, to 75,000. An amount they don’t think you can pay to get you out of their offices. Anyone who doesn’t think this is serious should know there are about 450,000 children in foster care in the US. The federal government, through the Social Security Act, pays the agency taking custody of your child $2,700 per month, the foster family gets $400 per month. this is in addition to medical, psychological….. While this is “protective custody” the judge is not in control of the child,CPS is.Even the ACLU, DOJ, FBI, won’t protect your civil liberties. Your child has none.

    Saddened mom I hope you will check this. My family has fibro and a lot of other autoimmune. My 16 yr old son is the one in my family who has the worst symptoms of my kids. We gave up on the doctors a long time ago. You really need to check into the Paleo community. There are gluten/casein and just plain ol’ food sensitivities that will cause this. We are curing ourselves. It is not fast and some days the detox hurts and makes us feel as bad as when we were eating the old way but it gets better. Good luck to you!

The admission team at Boston made this determination based on their subjective observations of child parent interactions under duress with an extreme case of flu in the picture? Did they consult her team of physicians she has worked with over the years? NO!! WTF is wrong with your brain? Maybe you need some shock therapy cause you have mad liberal disease.     Personally, I think this story may go deeper than just the typical ego-boosting some doctors crave. With the implementation of Obamacare, medical facilities, including hospitals, will have to ration care. The money just doesn’t add up. There will be too much demand and not enough supply. Perhaps, by diagnosing legitimate illnesses of minors as mental disorders, these facilities will be able to spread the treatment of patients over a broader area of specialty. By doing so, they accomplish several things. First of all, once labeled “mentally ill”, a citizen’s rights and constitutional protections would be effectively thwarted. Second, care for such individuals would be shared by psychologists, psychiatrists, child “protective” service agents, etc. thus, reducing the demand on hospital resources. Third, it would condition future patients and their families to just accept any amount of usurpation of parental authority by hospital personnel. Let’s not forget or excuse these renegade judges who are either confused about the Constitution or simply…EVIL.
    Yet another reason, we all need to be supporting the Parental Rights Amendment. If you don’t know about it, LEARN about it. It may someday be all that stands between you and a government/society that wants your children.

    Unfortunately I think in this case that Mr. Beck is being too quick to jump on a specific narrative without any real foundation. Since the gag order has meant that little to no medical information is available it leaves the field open for whatever the parents want to say. In checking the admittedly fairly dense descriptions of these two distinctly different pathologies it’s quite possible that what the hospital. and the girl’s doctors are doing is protecting her from pa parent or parents who themselves afflicted with Munchausen Syndrome by proxy (Google it as it’s too lengthy for here). The short version is “term that is used to describe a behavior pattern in which a caregiver deliberately exaggerates, fabricates, and/or induces physical, psychological, behavioral, and/or mental health problems in those who are in their care.”

    Mitochondrial disease is a usually genetic disorder that robs parts of the body of the ability to convert nourishment into energy and can exhibit a wide variety of symptoms and levels of severity. There is no cure or clear treatment and it usually leads to an earlier death.

    ” A somatoform disorder is a mental disorder characterized by symptoms that suggest physical illness or injury – symptoms that cannot be explained fully by a general medical condition or by the direct effect of a substance, and are not attributable to another mental disorder (e.g., panic disorder).” There is a correlation between the instances of somatoform disorders and Munchausen Syndrome by proxy that can’t be dismissed given by the information we have since a person with the earlier diagnoses of Mitochondrial disease most certainly DOESN”T lead a normal life.

    What I’d like to know is how often this young girl has been visiting various Drs. and/or hospitals.

    If you think the hospital is being driven by some sort of profit motive you know nothing about hospitals. Even if CPS were to give the hospital all of your claimed $7800 mount that would cover about 2-3 days of in hospital expense while undergoing treatment. There’s something much deeper going on here that isn’t being disclosed in any of the linked stories.

Physicians have many years of formal education to prepare them for the medical field. You are an idiot if you think you know more than a medical professional.     Mitochondrial disease is no piece of cake either but it does have one outstanding difference from Somatoform disease which is a broad category of physical activities based on a possible mental disorder. That difference is that unlike Somatoform, Mitochondrial disease is a genetic disease/disorder that leaves physical evidence of it’s presence while Somatoform does not. Given the little data given us it’ very likely that upon finding no such physical genetic markers or actual organ failure due to an inability to produce energy needed by an organ (s) the Drs. took into account a variety of different aspects of the case with which we no nothing.

    I’m putting m money on their deducing that what they were presented with is a case of Munchausen Syndrome by proxy which would fit what e know much better then some convoluted conspiracy by the state to take away a families children. I could of course be wrong but that’s a more realistic explanation without invoking the Boogey Man.

    You obviously have more links then the rest of us. You must have an inside source to be able to so emphatic about the Drs. never having talked to her previous Drs. and/or hospitals. I guess it isn’t even remotely possible that they did and found an alarming history of repeatedly visiting such folk, or heaven forbid they had sufficient previous experience with this family in their own hospital.

    Mitochondrial Disease is a molecular level genetically (most often) triggered disease that makes various organs in the body incapable of producing the energy that organ or organs need t operate. There is no known cure and precious little treatment available and a person so afflicted can hardly be said to enjoy a normal life since most die as a result.

    By the way, it also leaves easily uncovered physical signs that a doctor would know to look for internally having been told a child ad been diagnosed with it. That process takes hours not days or weeks, and absent any such signs any competent professional would look outside the body and start looking at history, including family interactions.

Even after 9 months no judge has been able to look at all the evidence presented by both sides and see what a terrible trick is being played on this family and especially this little girl. m guess he must also be part of the governments conspiracy to take on more expenses they can’t afford just to prove how powerful they are, and of course the hospital loves that extra $7800 a MONTH they get to share with CPS as that should cover about 2-3 days worth of the expense of keeping her given a hospitals average expense of $6000+ a day including treatments.

    One of the recurring thoughts I have quite often these days is that your faith, belief system, and how you view things is totally dependent on who you listen to, what you are taught, and who you hang around with.

    As I understand it, our current medical establishment and schools were started by Rockefeller way back in the early part of the last century. He put up the money to get them started and as a result, the old ways of natural healing with herbs, food, exercise, and old time common sense living were regarded as foolish and anyone involved in those things began to be regarded as quacks. The new methods were drugs, which are man made chemical concoctions, not natural, and many times cause more problems than they solve. Did you ever notice all of the side effects they name that are possible in using some of these drugs? The old school fellows that had treated people for generations could not be a part of this new system because they were deemed quacks. These new schools taught how to dispense drugs for illness, or cut things out, but only taught a couple weeks of nutrition, so these doctors don’t know squat about any of the old ways, or even healing for that matter. Think about this: do you know anyone that has ever been healed of high blood pressure, diabetes, or any other serious problems? Once they start you on a drug regimen, you take them for the rest of you life, and they add one every now & then to take care of the side effects that the others cause. Those drugs simply mask some symptoms, but never really get to the cause and heal you. Oh, I forgot to mention that now the drug companies help finance the medical schools. That’s a cozy nest eh?
    Don’t get me wrong, there are some good doctors out there, but they are few and far between because once they learn the system, it takes them a long time to realize what a bunch of lies and distortion there are involved in the methods they are taught. When they begin to recognize some of the wrongs, many are afraid if they begin to dispense some truth, they will lose their affiliations and licenses. Then where will they be?
    There are many treatments for high blood pressure, diabetes, cancer, and other big health problems that will work, but it involves life style changes like learning which foods are good for you and which ones you should drop, exercise, mental health, attitude, and outlook. The sad part is that we have become a people that want to pop a pill and take care of it instead of researching, finding the real cause. and treating it. We are each responsible for our own health and that of our loved ones. The internet is a vast resource we can use to help.

    B/S !! If even slightly true you learned NOTHING about hospital care and the functions necessary to stay in business and paying the immense costs of facility, equipment, and personnel employed and contracted.

    Before my retirement I spent 8 years on the board of directors of a fair sized medical center that was the home base hospital for the NASA astronauts. I witnessed and had to help find ways to offset the literally millions o dollars a year we lost operating everyone’s family Dr. in the emergency room plus the hundreds of thousands a year covering the unpaid bills of various local, county, and state patients who would get dumped on us PRIOR to their arrest so they could claim they weren’t their responsibilities until after they were arrested. In addition we had to cover the exorbitant costs imposed by the state and the federal government that required such specific building codes that our construction costs were most often 400% higher then that of competing Dr. owned and operated facilities and 10 times higher then the average homebuilder ever saw. Add in the extraordinarily high costs of staying current with the newest and most efficient types of high-tech medical diagnostic equipment such as CAT, PET, and MRI; all of which cost in the millions just for the hardware when first introduced and you get an annual expense that many hospitals simply can’t bear and still operate in anything resembling profitability.

    If nothing else Obamacare should tech more people just how complicated and expensive maintaining such a system is and as more and more will find out many of the best Drs. and hospitals in the country will NOT be available under the new mandates simply because they can’t sell themselves cheaply enough to be in the system devised by our friends in Congress

    Something else your 30 years didn’t teach you is the fact that medicine is not and has not been for decades a free market member since it is one of the most highly regulated undertakings in America with every governmental body at every level getting into the act.

    Back when I was a youngster 50% of every healthcare dollar spent came directly our of the pocket of the patient. Today it’s down to 12%, with all the rest coming from insurance companies, government agencies, and indigent care write-offs. You can bet that when it was ay 50% patients were a lot more aware of just who charged what, not so today…we just bitch about the pittance we pay and the level of service we think we should get for that.

If your case is made then why not have a 1-800 number for when your sick child is all night crying, and you have to go to work the next day.     I would also report this to the Hospital Board, the state board who certifies the hospital, the American Medical Association and anyone else you can think of, as well as local Business Bureau Association and the Newspaper. And find out if there is a local, state or national association for the disease which your daughter suffers from, and contact your local and national state and national representatives and senators.

    This is not the first child taken away from their parents at this hospital.My friend’s 16 year old daughter was held there for 9 months, gag order against the parents and their lawyer. All because the hospital decided that the diagnosis of P.A.N.D.A.S./P.A.N.S. (that they used to treat there) that was made by TWO physicians didn’t exist. Because the parents wanted them to treat her for it the hospital turned to DSS who promptly took custody.She is finally getting treatment and making progress, but so much time was lost. Not to mention the emotional toll it took on her and her family.There are more cases as well. What is wrong with these doctors?

    I posted again in this thread but I can’t find it. Why I repost and come back about what I was referring to. This girl isn’t being held due to any disagreement. She’s being held because she was deemed mentally ill, in which there is no legal recourse while in the process. I personally have seen many a parent or loved one escorted out of a hospital while I have taken their children to places all over the state. Sometimes a couple hundred miles away. This stuff happens all over this country. Maybe not as extreme as months but a week is common place. I did know first hand of a woman held once for nearly three years. I was on a psych committee and I’ve heard of future plans first hand. I’ll qoute are v.p. of the institution. ” Its not going to be about fee of service any longer” . This is an area getting ready to explode and those typical few day stays are going to be much longer. I’ve actually even been asked to consider a future transfer in the psych home health. I really got to finda new job.

However, It has been my experience to have too many arrogant over educated idiots who have agendas that over diagnosis people with real medical conditions as somatoform or conversion disorder so they don’t have to tell truth and say I don’t know what the is wrong with you. Too many think they infallible, Gods, who dispense drugs without even taking account the actual possible side effects of said drugs and long term issues that come up from the drugs and dismiss a patient’s reality. Chronic fatigue syndrome/fibromyalgia, mitochondrial disease, and POTS are a real medical diseases and they are missed over and over again by the lazy doctors who don’t want to work at researching or want rely on simple yes/no clinical blood tests. Human beings are complicated than computers and cars. YET we know glitches occur in both that can be intermintent and caused by a series of events..Too many doctors want to just concentrate on one small part of the body and not look at the whole system and how are bodies work together. Even the bottom of the graduating medical school class gets the title of doctor, same with those cheat their way through school. And all of the are practicing and experimenting on humans everyday..

    Obviously, you don’t know what you’re talking about. Munchausen syndrome is a diagnosis for an individual who seeks attention by deliberately doing harm to themselves or feigning illness. Munchausen by proxy is when parents or caretakers cause harm to their dependent in order to gain the same type of attention.
    The fact is that these doctors have committed this young girl to a sentence of confinement in a mental institution. Munchausen by proxy would have resolved all her physical symptoms as soon as the parents were prevented from controlling the daughter’s medical care. That has not happened. They have not released the daughter, they are feeding her powerful psychotropic medications that, in a child, can CAUSE psychoses, thus practically guaranteeing confirmation of their diagnosis.
    I don’t know where you’re getting your information, but stop trying to play doctor. This case is a travesty. I don’t need to read her medical file to know that a psych resident does not have the knowledge to counter her diagnoses without having even seen her previous charts or having spoken to her treating physicians, all of whom were in agreement as to the original diagnosis. A psych resident does not have the ability, in a couple of hours, to determine that the child should be removed from her parents simply for the crime of disagreeing with him. If I were to treat a patient in this way, I’d most likely be facing board sanctions after I was forced to explain myself. There is simply no justification for this.
    Worse, even if, against all odds, his diagnosis were correct, there is no reason to confine a young patient with somatoform disorder as she is neither a danger to herself or others. Somatoform disorders manifest as attention seeking, NOT suicidal. Worse, after removing her parents as her guardians, they then proceeded to isolate the girl from her family and friends. How exactly, does removing a child’s support system, isolating her in a mental facility and drugging her with medications that are NOT approved for children improve her care? There are no good studies of these medications in children because it is considered UNETHICAL to expose children to psychotropic medications in prospective, blinded studies. So we only know what these drugs do when doctors use them off label. And what is the most common and serious side effect we’ve seen in retrospective studies? Suicidal ideation, necessitating hospitalization. As I said…this is a self fulfilling confirmatory diagnosis.
    Get your facts straight. You’re not being “reasonable”, you’re just wrong.

    I AM a physician, so based on your reasoning, I’ll assume you won’t be questioning my answer because I “…have many years of formal education to prepare [me] for the medical field.” I don’t need to hear anything more than what I have read here to know that this diagnosis was made in haste and with no consideration of the child’s previous diagnosis with no objective testing that could reasonably justify what is a vastly complex disorder.
    This was a young psychiatry resident who, on the spur of the moment, and without having seen ANY of the child’s medical charts from multiple, other physicians, he refuted their diagnosis with one that matched his own particular training specialty, then called a social worker who enacted an emergency removal of parental custody.
    Even if, by some miracle, he was shown to be correct, he had no reason to hospitalize the daughter as somatoform disorder does not manifest in symptoms that are emergently dangerous to either the patient or to others. She has remained hospitalized, for all intents and purposes, incarcerated against her will and her parents have been prevented from having unsupervised contact with her and only once per week, although no abuse has even been alleged, a situation that, by itself, can CAUSE psychiatric illness, especially in light of the fact that she is being medicated with mind altering psychotropic medications not approved for use in children. This is LUDICROUS.
    There is no explanation for any of this. The diagnosis does not justify the medical decisions that have been made in this case. The “treatment” does not even remotely fit the diagnosis, especially her incarceration in a mental facility. My training and any reasonable physician could tell you that none of this makes sense, no matter the claims of the parents or the hospital. I don’t need to be “brought up to speed” on any of her treatment to know that it is wildly incompatible with the diagnosis that the psychiatrists have provided to the press. This is not explicable medically. It has been taken to an extreme that should land the perpetrators of this travesty before their state medical licensing board. I’d LOVE to hear them try to explain this one to a panel of adjudicating physicians.

    None of this passes muster as justification for removing a child from loving parents, then incarcerating and medicating her while isolating her from the only support system she has ever known, all with no allegations of abuse. In order to justify such drastic measures legally, normally, physicians are required to provide evidence that the child is in acute danger. None of that has been alleged here, yet, they enacted the most extreme of questionable treatment measures for a diagnosis that is not even truly a diagnosis. It’s a description of a plethora of disorders, none of which usually requires incarceration.

    I am so sorry for your loss. The same thing happened to my friends. Their teenage son was diagnosed with a rare disease. They took him to get treated at a hospital and because of a typo on one out of four doctor’s referrals, he was taken by CPS and put in foster care. He almost died while in the system due to lack of proper care for his disease. They fought a long, hard battle with CPS for over a year. After switching lawyers several times, no one would take their case and they were refused treatment for their son at every turn. They eventually left, yet were still pursued by CPS. I lost contact with them, but the last thing I heard was that he was going downhill fast and they have no one to turn to for help. These stories need to surface. Good parents, doing the right thing for their children, yet treated like criminals for it, is an absolute outrage against humanity.

    Same thing happened to my sister’s son in North Carolina – he was diagnosed with a mental condition and took custody from my sister who is not allowed any say so for any of the treatment her son is receiving. She was not allowed to confront the hospital in a court of law because the federal laws the hospital was using forbid it. She was never allowed a hearing or representation in the courts when the hospital decided they wanted custody…the child was simply taken and given drugs my sister has idea for what or what the side effects are.

    This is why I am going to get my degree in Psychology. Psychologists are the ones who can trump the DCYS and greedy lawyers in family court. They need to call their Atty Gen and Governor but FIRST they need to get a Psychologist who disagrees and a trained lawyer who knows UNCRC laws and is fighting for the new Parental Rights Law…..HSLDA is the one they should call. They also provide lawyers in any State. I’ll be graduated in 2016….so don’t worry – I’ll fix this mess! I fought this myself and won – 3 wks after telling the Gov the GAL’s were violating my rights he said he was sick of hearing parental rights being violated and fired them off the State Budget!!!! Good ol’ Governor Lynch!!!! Not only that, I banned her from being around my children and then made a police report against her for abducting my children for questioning for 2 hrs, I put an APB out on my kids. I’ve worked in the medical field and haven’t been able to read most of the doctors notes and some of their grammar was so bad it could have caused the wrong treatment to be administered. They actually cause people to suffer, as we have to make the patient wait for clarification.

    This will stress her limbic system, particularly her amygdala which can shrink due to trauma such as this. Actually, by doing this to her this could provide evidence that this stressed her out and was “not in the best interest of the child.” Also, any diagnosis made while the patient is processing such trauma, makes it impossible to ever get an accurate diagnosis. A Psychologist is the only one who can fix the situation now. But this can be done! The family should hire a competent one who has successfully won cases like this in court.

    Thanks for the information. This is the problem of gag orders, you can’t get the whole story, so reporting it was kind of futile and rather frustrating. One thing to consider is that no one can Psych diagnose any parent without a proper analysis and this is their grounds….unless they found the parents did have psych issues. Either way, the answer is to get additional eval’s and for the parents to clear their name with the mandatory psych eval’s and/or counseling needed to prove they are fit parents. But they needed evidence before removal, not that all Judges are competent with restraining orders~ this being more of the issue here I’m sure. The court industry is fueling the medical industry….oh wait, or is it the other way around??

    Who is paying those doctors? Do the parents have private health insurance in effect? Is the child on social security? Who is receiving it? Is the child on medicaid? Who pays the expert fees for the doctors to go to court? If the parents change insurance providers so the in network providers change, would that impact which doctors treat her? I know she is young, but has anyone looked into an emancipation process? Is there a Guardian Ad Litem appointed for her? Can she become a party to the case and have her own legal counsel? Who is educating this child? Who is paying for that education? Did anyone follow the money trail? Are they tracking the deadlines for statute of limitations? Did anyone contact former employees to see if they have insight? Did the family members join any committees, panels, or public groups at the hospital? Are the medical care providers considered employees of the state? Are their personnel files public record? Is the state medical board involved? And, most importantly, pray.

    If you watch the news video, they interviewed her long term psychologist. His testimony and opinion have been completely ignored in this case from the beginning. The only thing that makes any sense on this issue is that someone’s ego is involved and that led to a lot of exaggeration and lying.

    Once that student called child protective services it is out of anybody else s hands. From that point the state and courts are involved. Doesn’t matter what the medical team or anyone else says, it has to go through an investigation and that report to the judge along with the child protective services worker’s opinion if it is a “founded” or “unfounded” case. If they say it is founded then you are put immediately on the child abuse registry. Of course all this investigation and court dates takes months so in the mean time if you have a sick child with a life threatening illness like mine did, time is of the essence and all her medical decisions made by CPS and the court were lethal – a death sentence to her. When I pleaded with them and the judge I was screamed at and called a “monster” and that I didn’t care for my daughter – and that I am not the expert to be making medical decisions for my child. I am telling it like it is and how it actually happened. Even if the person who makes the call with allegations retracts what they said or all evidence shows your child should have never been taken, it doesnt change the time it takes, it still HAS to go through the court system. Even these kids who have been returned home and court rules it was a mistake to have taken the child in the first place these families are always court ordered to continue with family visits with CPS and that nonsense until the court releases or closes the case. The whole system is a sham.

    There is such a thing called “covering up” to escape responsibility and a lawsuit. in my case, cover up also covered their hide for payment by the insurance company for the astronomical medical and psych expenses.     I agree with you but this has to be done now who will do all of this. I would or will call my congress persons and representatives. But the television stations are broadcasting this now. I don’t see any action. An attorney would probably be too late for the girl who died in the 2 1/2 months… I do not want guns to be a part of this. There are innocent people working in the hospitals… who have no control over this..

Though the hospital, police, etc said what the parents can or cannot do, there is the issue that concerns what the parents did or did not do as a result of the threats, as they have a RIGHT to pursue solutions, regardless of what the hospital or police threatened them with.

You have to recall that they disagreed with the diagnosis, and then tried to discharge her. That just doesn’t work with psych patients. If that had been an adult, they still would have forced a watch. Now, I’m not sure what the 9 months is about, but I can imagine it has something with the parents not wanting to pursue a psychiatric diagnosis. They’ll keep your kids if they think you’re not going to take care of them, it’s true.
    Moral of the story: Try to trust doctors some, hm? They know what they’re doing, and the state knows it.

    Ya I find the nurses in the hospital have become worse, I was with my Husband after his triple bypass Surgery, and the night nurse was peeved off i was there all night with him, when he would wake up I would stand next to his bed and rub his arm, he had the OC2 masks tighten to his face and hands tied to the bed, he woke up asking for water, so when Susan his night nurse came into the room, I told her he wanted water, she told me he is just rambling. and I said no I heard him clear he wants a drink, she took the mask off and he said it again, she clamped it back on, and said he can’t have any because he can’t have the mask off, the nurse helping said we can swab his mouth, and Susan said NO we are not taking that mask off. after the other nurse left the room, Susan informed me if i was to be allowed to stay the night, I better stop upsetting him. I was surprised to hear that, if that was her interpretation of upsetting. Then she spread the word around to staff that i didn’t want him to wear a mask, that i caused trouble. They were actually thinking about kicking me out for good, My Husband over heard this, and with chest still left open, sat up in bed and threw a fit, it took 3 doctors to calm him down, and they decided differently about kicking me out. I heard about this from him later on. He ended up dying 3 months later from infection in his chest. He’s my superman, to fight for me even in the conditions he was in. But they could never have kept us apart. I would have swung from the windows out side to let him know i Loved him. only had she known he was Claustrophobia, and I was the one keeping him calm threw the night. Maybe these people need different Jobs.

    I would get hit by a car myself and end up there as a patient if it was family, they can’t throw you out if your a patient . I almost got kicked from my husbands room for good because i told the nurse he wanted a drink. she tried her hardest to get me kicked out, said i was causing problems about his O2 mask. out the door and right back in if it was me. now I won’t go to a hospital. he died from infection 3 months later, and I hate hospitals, I would rather die then to conform to there crap.

    I am so sorry about your daughter, and your loss. It’s bad enough to have a beloved child sick with cancer, but, to lose control and see her go through needless suffering is horrifying. I don’t know how you are able to get through it. I feel like crying after reading your daughter’s suffering and death from complications.

    Yet, I feel this case is possibly different, and we’re only able to hear one side of this incredible story. For us to grasp that they have wrested control of this girl, and effectively are holding her prisoner for close to 10 months, we’d have to accept that not only multi-disciplinary specialists are involved in a conspiracy, but, so are social workers, judges, and hospital administrators.
    That’s hard to grasp in a place like Children’s of Boston.

    No, I think there’s far more to this. While I believe these parents are truly loving, and decent people, there’s a legitimate basis for the hospital to believe she was falsely diagnosed, and was on a dangerous regiment of drugs and needless surgery.

    The parents claim that Children’s has an agenda to do secret research on their child, but, did it ever occur to them, that the ”mitochondrial specialist” in Tufts, has far more incentive to use the girl for his own research and background, which he has been forging a new category in genetic diseases, that little is known, and much of what is known is debated.

    If she’s been on the hook for the Tuft’s doctor, feeding her drugs, which may be worsening her symptoms and doing surgeries, which could be harming her, then Children’s Hospital, the social workers, the various neurologists and psychiatrists, as well as the judges and litigators, truly believe they must save her from.

    If she is unjustly being held prisoner, this specialist from Tufts should be the one to mediate her release, but, it doesn’t sound like he wants to be involved, which leads me to question whether he’s the one who’s been misleading this family, and harming this girl, to advance his revolutionary genetic breakthroughs, for his own agenda.

    We need to look at all angles in a story before running around accusing all these disparate individuals of collusion to kidnap a child for use as a guina pig.

    Actually, you don’t understand how this system works. The legal system is depending on only one specialty and that is psychiatry, the least scientific branch of medicine. I’m a doctor and frankly, based on their diagnosis of the girl, what they are doing can only be explained or justified on the basis of ego. I’d challenge anyone to produce evidence that long term isolation and incarceration are viable treatment regimens for somatic disorder. Why are the parents limited to one supervised visit per week? How exactly is that helping this young girl?
    You need to stop trusting that just because a team of “doctors” (I use that term very loosely in the case of psychiatrists) are doing what is in the best interests of the child. This is unsupportable under the most extreme cases and was enacted in too short a time to justify the actions that were taken. I have seen many cases of an egotistical physician controlling a case, especially when the government is utilizing their opinion to justify legal decisions. This can be traced back to one person.
    No, I do not believe everyone is in on a conspiracy. But I know for a fact that the judge and CPS are using the opinions of only the team of doctors who have a vested interest in seeing the girl incarcerated. And, unfortunately for the family, this has gone too far now for them to back off. They’ll fight to the death to maintain control of her care and her family alienated from her care if it means having to back off and eat crow. What these doctors are doing should be brought before the state board. There is no way that this case would survive the scrutiny of a panel of impartial physicians as they have so drastically left the standard of care that their actions have now entered the realm of the ludicrous.

    I really disagree with Glenn Beck – a lot — but he is absolutely right to expose this story and it is upsetting that so few others will. This is happening — if you disagree with a “mental illness” diagnosis, whatever your political leaning – but especially if you are intelligent enough to do the research and know what you are talking about and have reasons to be concerned about psychotropic drugs — YOU WILL BE RAKED OVER THE COALS – no matter what you’ve done or haven’t done, CPS will find something and will lie and exaggerate and this agency has NO OVERSIGHT whatsoever – and the attorneys, the courts, and law enforcement all do what CPS dictates – it IS a dictatorship, and there must be oversight – limiting of powers of Child AND adult “protective” services.

    YES — CPs and doctors accuse parents if they are not perfect — but CPS and Doctors have immunity from ANYTHING they do unless you are wealthy and can find a lawyer who will sue them — NOBODY will sue CPS — only one case published in Reader’s Digest from 2007 have I heard of where a lawyer helped a couple who lost their child over a misdiagnosis issue.

    I don’t know exactly what is motivating this trend, but it IS a trend, and it’s either CPS overreacting so they won’t have to deal with any liability issues or they have been brainwashed to believe people need to be on psychotropic drugs – or some other agenda is being promoted. However, the reality is that these cases are not isolated, and many times the parent is diagnosed with Munchausen’s by doctors who have never seen them as patients — there is a M.A.M.A. website about this.

    Yes, they use your children to blackmail you into submission – If you try to get publicity, they have the power to distort any record and use it against you — If you don’t have a paid attorney, your public defender is not going to take the time to bring in experts to testify on your behalf —- if you seek publicity the public defender tells you that you are making yourself look bad to the judge — and they judge does what CPS says — and/or believes what CPS distorts. What’s worse is that the law allows HEARSAY during the hearings and they use that to keep the child which they are out drumming up any “evidence” they can find from years past to use against you — especially if you are not conservative – if you ever used integrative medicine, vitamins, or esp homeopathics — if you question vaccines — They use anything, but especially your love for your children – against you.

    You are right — but you have to know how to file motions and know how the court process works, and in these cases all the rules don’t apply — or at least according to the process they don’t — We need lawyers with guts and integrity who will take on these juggernauts —- we need oversight of this process —

    the “hearsay” rule that allows CPS to allege anything they want to allege should be amended — especially where there is no apparent danger to a child.

    The system is RIGGED against parents — and if you even expose fraudulent activity by a caseworker, the court and police cover up for caseworkers — but they use everything to go after you – even if there’s an explanation. You are told the court doesn’t care about the facts during the hearing process, so the parent can’t even present his/her evidence to counter the hearsay until the adjudication process – by the time you get to that – DSS has all the taxpayer money it wants to gather all kinds of lies about you- that you can’t even begin to counter with your limited income.

    It is more likely that this case is depicted as it is- because this is happening all over the country – just because parents are not perfect doesn’t mean a hospital can refuse to speak to other doctors about other diagnoses. Even if parents are wrong, but are acting in good faith based on other doctors’ recommendations, that is no excuse to take their children from them.

    Mike you are under the false impression that lawyers actually take these cases — THEY DO NOT! I’m am absolutely certain that these parents have tried to retain a lawyer — And if you don’t have money – mostly because you’ve been dealing with a child’s illness for years — you CAN’T get a lawyer who won’t work on contingency basis.

    A parent can’t support the child that’s being traumatized as Justina is and also spend all day every day looking for a lawyer that cannot be found.

    give it a try – pretend you are these parents and find a lawyer who will take this case —- and tell them you have no money to pay them up front.

    Let us know who you find and I know I will call that person.

    However, IF you can get the media involved, THEN a lawyer may be found–Getting the media involved is the hard part,
    and again, the COURT will hold these efforts of publicity AGAINST YOU — unless you CAN get a real lawyer.

    YES – you are absolutely right. And even questioning vaccines is treated like a crime– even though it is perfectly legal to question vaccines and ask for an alternative schedule or exercise your parents’ rights not to vaccinate.

    It seems to me that if a judge ordered a “gag” order, something isn’t on the up and up between DCS and the doctor. The judge that ordered this gag order is probably getting a big payoff to do what this doctor wants done. The FBI needs to investigate this, because kidnapping is a federal offense!

    It’s not just the doctors, it is anyone in power who thinks they know more about your child then you do! Once you speak up or show evidence of a fight for your child’s rights, the hungry egos just become hungrier. I am going through something similar right now. And living under threat of my son being taken away, so I canot say much here in fear of it being twisted and used against me. Mine came in the form of a state agency, a nonrofit agency, and a Superior Court Judge. I was facing allegations whichI easily disproved and was exonorated of in court, then the judge sentenced me, rather court ordered me, under threat of losing my son, to attend a meeting on behalf wih, with non-profit agency, and comply with whatever they wanted to do with him. I was outraged and there was nothing I could do. Then when thegecy called me, they adding stipulations, ach one removing another of our rights, and finally, when they said they were bringing their lawyer to this meeting and I couldn’t bing ne, I said, “No”. They have hence said that I did not cooperate, as ordered, and when this is reviewed this summer, my fragile boy will be taken away from the only home and loving parent he has ever known. I have been warned not to use the words, domestic terrorism, but that is exactly how I feel.. Terrorized. The worst part is when no one believes you, because after all, “Our leaders in hgh places would never be involved in such wild conspiracies, so there must be more to the story then what you are saying.” I might have even been guilty of that attitude myself once or twice. Not any more. No lawyer will take your case because they have to practice law in that same courtroom where you say the judge violated your rights, and if yu geta lawyer from out of the county, they want $10,000 cash as a retainer, because your case is complicated, since it involves a judge, a state agency and a nonprofit, under that state agency. So you folks who are wanting to help these parents and don’t know how, shell out some cash to a defense fund for these parents, because even if they win, they will be n debt for years to come with their legal fees. Ask the parents to set up the fund a bank, then post this story on Fb, twitter it, and get it out there, asking for donations to be sent to the fund. That is thing you can do, so wn or lose, these people can live frre o debt. Because even when you win a battle like this, you still lose, if you have to declare bankruptcy, ruin your good credit, and ruin your good name. That’s how the courts and the agencies and big hospital lawyers usually win, they break you financially first, and when you have no more money to fight, they take your chidren.
    That’s where I am now, no more money to fight, no pro bono offers from attorney, and I even wrote my congressman in desperation, who wrote back and chastised me for not complying with a the court order. Here in California, the word cooperate, means “Do exactly as told, whether you believe it to be in the best interest of your child or not.” My heart goes out to every parent who has experienced this bullying with your child as the pawn. It is so painfully wrong, and so often covered up, we seldom hear about such things, but it is a growing epidemic. Research CIR stories on California’s DDS, and how they treat the mentally afflicted people they wrest from a parent’s care, after they get them. You’ll really be sickened.

    Thank you for reporting this story. If the hospital and or doctor’s are found negligible I hope the doctor’s loose their license and the hospital administrator is fired and fined and the hospital is forced to pay the family millions.
